The Tenant and the Landlord each <br />covenant and agree not to block such roadway or driveway and <br />not to permit any employee, customer, invitee or other person <br />-13- <br />or persons to wholly block or materially block such special <br />driveway. Landlord agrees to grade and adequately gravel the <br />surface of such special driveway. <br />Rubbish <br />37. The Tenant agrees not to accumulate or, pile up refuse <br />Snow <br />or any other unsightly rubbish upon the leased premises or upon <br />the premises of the Landlord adjacent thereto and to promptly <br />and regularly remove all refuse and rubbish from the leased <br />premises. The Landlord will remove snow from the special drive- <br />way herein provided for Tenant when, and only when, the Land- <br />lord finds it necessary to remove snow from its own premises <br />through use of mechanical equipment. <br />and <br />Indemnit 38. The Tenant further agrees at the expiration of this <br />lease, or upon a breach by the Tenant of any of the covenants <br />herein contained, to quit and surrender the possession or <br />occupancy of such premises in as good condition as reasonable <br />use and natural wear and decay thereof will permit, damage by <br />fire, superior force or inevitable necessity excepted, AND <br />WITHOUT FURTHER NOTICE, except if otherwise required by law. <br />The Tenant further agrees that any subletting or assignment <br />of this lease as herein permitted shall be conditioned that <br />any such subtenancy shall automatically terminate on the termi- <br />nation, cancellation or expiration of this lease, and that such <br />sublessee or assignee shall waive notice to him, her or it and <br />agree that any and all notices from Landlord to Tenant shall <br />constitute and be notice to such sublessee or assignee of the <br />Tenant. <br />-13- <br />
