EASEMENT AGREEMENT <br />KNOW ALL MEN BY THESE PRESENTS: <br />That Whereas Claire P. Detweiler and J. W. Detweiler, also known as John W. <br />Detweiler, each in her and his own right and as spouse of each other, of Hall County, <br />State of Nebraska, hereinafter designated as first parties, did reserve in their <br />, Jr... who with his wife, Barbara G. <br />Glover Jr <br />warranty deed in favor of Herbert F. <br />Glover, both of Hall County, Nebraska, hereinafter described as second parties, <br />which warranty deed is recorded in Book 119 of Deeds at Page 187 in the office of <br />the Register of Deeds of Hall-County, Nebraska, an easement unto said Claire P. <br />Detweiler over, across, under and upon <br />The westerly 8 feet of the easterly 22 feet of the southerly <br />72 froadof� Addition Seven <br />Grand I land, One <br />iin Hall County, Nebraska, <br />Railroad <br />for use, maintenance and repair of the water line and gas line situated thereon on <br />October 12 1956, and serving that part of Iota Seven (7) and Eight (8) in said <br />Block One Hundred Seven (107) of Railroad Addition to Grand Island, Nebraska not <br />conveyed to said Herbert F. Glover, Jr., by -said warranty deed above described for <br />so long as said water and gas pipes and main on said premises on October 1, 1956 <br />shall be continued to be used to serve <br />The northerly 60 feet of said Lot Eight (8) and the northerly <br />60 feet of the easterly 22 feet of said Lot Seven (7), <br />being served thereby on October 1, 1956, and for the purpose of releasing said ease- <br />ment therefrom and creating a new easement in lieu thereof, said parties do hereby <br />agree one with the other as follows: <br />First parties do hereby release the easement hereinbefore described in full <br />> -and do hereby declare said easement fully terminated, in exchange for which release <br />second parties do hereby grant unto said Claire P. Detweiler an easement over, <br />across, under and upon the following described tract, to -wits <br />Commencing at a point on the southerly line of Lot Seven (7) <br />in Block One Hundred Seven (107) of Railroad Addition to Grand <br />Island, Nebraska, according to the recorded plat thereof, which <br />point of beginning is 30 feet westerly from the southeast cor- <br />ner of said Lot Seven (7), running thence northerly and parallel <br />to the East boundary line of said Lot Seven (7) a distance of <br />76 feet, running thence easterly and parallel to the North <br />boundary line of said Lot Seven (7) to a point 22 feet westerly <br />of the easterly boundary line of said Lot Seven (7), running <br />thence northerly and parallel to the easterly boundary line <br />of said Lot Seven (7) a distance of 6 feet, running thence <br />westerly and parallel to the northerly boundary line of said <br />Lot Seven (7) a distance of 14 feet, running thence southerly <br />and parallel to the easterly boundary line of said Lot Seven <br />(7) to the southerly boundary line of said Lot Seven (7), <br />running thence easterly along and upon the southerly boundary <br />line of said Lot Seven (7) a distance of 6 feet to the place <br />of beginning, <br />said easement being granted for the use, maintenance and repair of a water line and <br />gas line to be laid on said tract covered by said easement by second parties at the <br />expense of second parties and connecting with the present water and gas mains now <br />serving the premises described as <br />The northerly 60 feet of said Lot Eight (8) and the northerly <br />60 feet of the easterly 22 feet of said Lot Seven (7) <br />to the water and gas main now running along the JWAWly edge of aaid Lot 7, the <br />cost of the laying of said lines on the premises covered by this easement and the <br />connections of said lines to make them of service to the premises for whose use <br />and benefit said lines are to be laid, shall be borne by second parties; this <br />easement shall remain in full force and existence so long as said water and gas <br />
