It is further mutually agreed and is one of the con- <br />siderations of this lease in conformity with the intent and the <br />carrying out of the terms of the lease in the gravel opeations, <br />that the owner does hereby grant to the gravel operators an <br />easement 50 feet wide across and along a property line of the <br />described property for the purposes of moving and handling gravel <br />from adjacent or abutting tracts of land when the gravel <br />operators are actually carrying on operations in the production, <br />transportation, marketing, and sale of gravel from lands of <br />others adjacent or abutting to the lands of the Owner herein des- <br />cribed. The use of said easement shall be a part of the opera- <br />tions on the Owner's premises; and that at the election of the <br />Gravel Operators, should lease be terminated as herein provided, <br />the easement shall remain in effect so long as the Gravel Opera- <br />tors pay to the Owner the annual payment of $75.00 for the use of <br />said easement or easements as herein set forth for active use by <br />the Gravel Operators. <br />The Gravel Operators shall keep books showing a com- <br />plete record of sand and gravel removed from the Owner's premises, <br />which books shall be open to the inspection of the Owner at all <br />reasonable hours. The payments of cash rentals hereunder of One <br />and 25/100 Dollars ($1.25) per railroad car and Five cents per <br />cubic yard for gravel otherwise shipped, as herein set forth, <br />shall be paid each calendar month within thirty days after the <br />expiration of said month, and any amount accruing as minimum <br />annual payment for any lease year shall be payable within thirty <br />days after the expiration of such year. As to sand and gravel <br />removed from the premises by railroad, payment shall be made on <br />the basis of the railroad company's records. <br />It is mutually agreed, and it is one of the considera- <br />tions for this lease; that the Gravel Operators may at any time <br />on or after July 11, 1963,, terminate this lease and all future <br />liability thereunder, should it in its judgment find it inex- <br />pedient or undesirable to carry on further gravel operations on <br />the leased premises; by giving three months' notice of said <br />-3- <br />
