In the Matter of the Title to Lots 3, 4, and 9, Block 15, <br />Town of Wood River, Hall County, Nebraska <br />STATE OF NEBRASKA ) <br />(SS: AFFIDAVIT <br />COUNTY OF HALL ) <br />----- - - - - -- <br />B.J. Cunningham, being first duly sworn on his oath, <br />deposes and says that he was the attorney for the Estate of <br />Lottie Burmood, deceased, who formerly owned the above <br />described lots; that affiant was personally acquainted with <br />Esther Laura Tibbits, daughter of Lottie Burmood, deceased; <br />that one -fifth interest therein passed and descended to the <br />said Esther Laura Tibbits, daughter of Lottie Burmood; <br />that the said Esther Laura Tibbits departed this life on <br />October 12, 1950; that she left surviving her, Archie C. <br />Tibbits, a son, and Emma Myers, a daughter; that the said <br />Emma Myers and husband conveyed all of their interest in <br />the above described property to Herbert 0. Bonsack by deed <br />recorded in Book 114 at Page 37 of the Deed Records of <br />Hall County, Nebraska; that in the probate proceedings in <br />the Estate of Esther Laura Tibbits said Emma Myers was <br />referred to and described as Emma Meyers in the petition <br />filed for probate and that the said Emma Myers was des- <br />cribed as Emma Meyer in the final decree entered in said <br />estate. <br />Affiant further states that the difference in said <br />names wa& a typographical error and that affiant knows of <br />his personal knowledge that Emma Myers is her correct <br />name and that Emma Myers described in the above deed and <br />Emma Meyers described in said petition for probate and <br />Emma Meyer described in the final decree is one and the <br />same person, notwithstanding the discrepancy in the <br />spelling of said name. <br />Further affiant sayeth not. <br />AFFIANT <br />Subscribed and sworn to <br />November, 1956. / <br />My commission expires <br />s � day of <br />ICdo ,, <br />A <br />Filed for record November 21, 1956 at 200 P.M. �� <br />Register of'Deeds <br />Hall County, Nebf. <br />
