I, Fred J. ?lagge, being; first duly sworn, on my oath depose and say that I am one and the same and identical person who executed and acknew- ledged the 4arranty Deed recorded in Book 114 at Pa<;e 307 of the Deed 'Records'of Hall County, Nebraska, on INay 25, 1955, con:reying Lot :.Fourteen (14) in Hagges' Subdivision of a part of the Northeast Quarter of the Northwest Cuarter (NE4I�'VT1) and a part of the Northwest Quarter of the Northeast Quarter (N4vYA1r,'. ), all in Section Twenty - eight (28) in Township Eleven (11) North, Range Nine (9), West of the 6th ; .141., in Hall County, Nebraska, to George �. Alexander and Mary E. Alexander, husband and wife, as Joint Tenants and not as Tenants in Common, which deed contained the following provision: "subject to and with the benefit of the restrictions contained in the deed to George E. O'Brien recorded in 'ook 100 at Page 600 of the Deed Records of Hall County, _Nebraska."; that the scrivener of said deed made two errors with respect to said deed last above referred to in that the Grantees in said deed were, in fact, George B. O'Brien and Irene CfBrien and said deed was recorded in Book 100 at Page 666 of the Deed Records of Hall County, Nebraska instead of in Book 100 at Page 600 of the Deed Records of Hall County, Nebraska; that it was my intention in said deed recorded in Book 111G at Page 307 above referred to, to convey said Lot Fourteen (14) above described subject to and with the benefit of the restrictions contained in the deed to George B. O'Brien and Irene O'Brien recorded in Book 100 at Page 666 of the Deed Records of Hall County, Nebraska.
