EASEMENT <br />i <br />WHEREAS, Thomas E. Christensen and Earl L. Christensen, co -part- <br />ners d/b/a Christensen Concrete Products as owners of Lot Three (3) and <br />part of Lot Four (4) in "i:ains First Addition" to the City of Grand Island, <br />Ball County, Nebraska and Christensens, Inc., a corporation as owners of <br />part of said Lot Four (4) and all of Lot Seven (7) and that portion of <br />Thomas Avenue and Harry Avenue vacated south of Roberts Street in said <br />"mains First Additions" have at their own expense laid and installed a wa- <br />ter main over and across,the northerly eight (8) feet of said premises and <br />on the south side of saicS Roberts Street, which main is owned by said par- <br />ties hereinabove named, and which is conri'ected at the +westerly end, to water <br />mains of the City of Grand Island; and <br />' SH]KAS, said owners are desirous of having the City of Grand <br />Island install and construct appropriate fire hydrants on said premisesto <br />be connected with such privately owned water main to service areas surround- <br />ing such hydrants as the fire department or other departments of the City <br />of Grand Island may from time to time deem necessary;rx)w <br />THEREFORE in consideration for the City of Grand Island installing <br />and. connecting fire hydrants to such privately owned water main at such <br />point or points as deemed in the best interest of the areas to be serviced <br />by such hydrants without cost to such owners of the main, the owners as <br />hereinabove named do grant to the City of Grand Island an easement and right.-- <br />of way over and across the northerly eight (8) feet d' the real estate here - <br />inabove described for the purpose of constructing, installing, connecting, <br />maintaining, and using fire hydrants as may be deemed necessary to service <br />and protect the areas surrounding these hydrants with the right to enter <br />upon said northerly eight (8) feet to maintain and repair such mains when <br />necessary to keep the hydrants in useable condition, should the owners fail <br />to .do so. Title to the existing water main, exclusive of any hydrants or <br />connections made by the City of.' Grand Island, together with the right to de- <br />termine what connections may be made to such privately owned water main for <br />purposes other than for necessary fire hydrants shall remain in the owners <br />above named and they agree to do nothirig to interfere with the flow of <br />water through such main to the hydrants.
