JOSEPH R`R D ISLIl I�AT -COM- <br />PANY, a corporation of the States of Kansas and Nebraska, and <br />its Lessee, UNION PACIFIC RAILROAD COMPANY, a corporation of <br />the State of Utah (hereinafter collectively called "Railroad <br />Company "), and NORTHWESTERN PUBLIC SERVICE COMPANY a corpora- <br />tion of the State of Delaware (hereinafter called 'Licensee "), <br />WITNESSETH:. <br />RECITALS: <br />The Licensee desires to construct, maintain, <br />and operate a 6 -inch gas pipe line (hereinafter re- <br />? ferred to as "Pipe Line ") across the right of way <br />and under the track of the Railroad Company's main <br />ti. line at a point 1,378 feet distant (when measured <br />along the center line of said track) southerly of <br />the east and west center line of Section 20, Town- <br />ship 11 North, Range 9 West of the Sixth Principal <br />Meridian, near Grand Island, Hall County, Nebraska, <br />v in the location shown by dashed yellow lines on the <br />print hereto attached, dated May 14, 1956, and <br />marked "Exhibit A." <br />I M AGREEMENT : <br />NOW THEREFORE, it is mutually agreed by and between <br />the parties hereto as follows: <br />Section 1. RAILROAD COMPANY GRANTS RIGHT. <br />In consideration of the sum of Ten Dollars ($10.00) <br />to be paid by the Licensee to the Railroad Company upon the <br />execution and delivery of this agreement, and in further con- <br />sideration of the covenants and agreements herein set out to <br />be by the Licensee kept, observed and performed, the Railroad <br />Company hereby grants to the Licensee, subject to the terms <br />and conditions herein stated, the right to construct and <br />thereafter, during the term hereof, to maintain and operate <br />the Pipe Line across said right of way and under said track i <br />the location shown by dashed yellow lines on Exhibit A. <br />1 <br />
