expense of constructing and maintaining the part of said pipe <br />line extending from Well ##1 to Well #2, and they, the said <br />second parties, shall be the absolute owners of said part of <br />said line. <br />3. Any future maintenance cost on the line extending <br />from the said main of Kansas Nebraska Gas Co., Inc., to Well <br />#1 shall be paid by first and second parties equally as long <br />as both parties continue to use the line; should either party <br />discontinue using gas for power as aforesaid, then the main- <br />tenance cost shall revert 100% to the one continuing to use <br />the line; but in no event shall the line extending from said <br />main to Well #1 be taken up, removed, or displaced without <br />the full approval of both parties. The party intending to dis- <br />continue use of said line for power as aforesaid shall notify <br />the other party in writing of such intention, and the obligation <br />as aforesaid with respect to the expense of maintaining the line, <br />shall continue until such notice is given. <br />4. No third party or parties shall be permitted to connect <br />with said line or any part thereof, without the approval of both <br />first party and second parties expressed in writing and signed <br />by the parties hereto; in the event such approval is given,then <br />any compensation received from such third party or parties shall <br />be prorated between the two parties hereto in the same proportion <br />as the total original investment made by each party bears to the <br />total expense of the entire line; that is, for the first party, <br />
