<br />JOHN F. McCARTHY, being first duly sworn, deposes and says
<br />that he and Pearl E. McCarthy, his wife, were the joint owners
<br />with the right of survivorship of the following described property:
<br />Commencing at the Northeast corner of the SW,, Section
<br />17, Township 11, North, Rpnge 9, West of the 6th P.M.;
<br />thence West along the North ling of said Quarter Section
<br />330 feet, thence South parallel to the East line of said
<br />Quarter section 610 feet, thence East parallel with the
<br />North line of said Quarter section 330 feet to the east
<br />line of said quarter section, thence north along the
<br />east line of said quarter section 610 feet to the place
<br />of beginning,
<br />and that they received title `o said described -property from
<br />L,orena 0. Andre on the 20th day of July, 1.946, said deed being
<br />recorded in Book of Deeds 89, Paje 352, Register of Deeds office,
<br />Hall County, Nebraska.
<br />Affiant further states that on the 26th day of May, 1948 he
<br />and the said Pearl E. McCarthy conveyed the above-described-prop-
<br />erty to Albert G. Lake and Zoe Lake, husband and wife, by war-
<br />ranty deed recorded in Book of Deeds 91, Page 181, Register of
<br />Deeds office, Hall County, Nebraska; that due to a scrivener's
<br />error the North boundary of said property was described as 333
<br />feet West from the point of beginning instead of 330 feet, which
<br />in fact was the true and intended description, and that the South
<br />boundary of said described property was correctly described as
<br />330 feet; that he and the said Pearl E. McCarthy intended to con-
<br />vey a tract 330 feet East and West by 610 feet North and South.
<br />Affiant further states that neither he nor the said Arthur
<br />G. Lake and. Zoe Lake claimed title to more than 330 feet west of
<br />the place of beginning of the above described property and that
<br />the overlapning 3 feet in said described. deed was a typographical
<br />error and that said property was correctly described when recon-
<br />veyed. to Wilbur 0. and Norma L. Sargant by deed recorded in Book
<br />of Deeds 97, Page 556, which deed shows that both the North and
<br />jf ,boundary of said

<br />330 feet with no
