Beers, ) <br />Defendant ) <br />This matter coming on to be heard on the 21st day of March, 1952, upon the <br />petition of the plaintiff and the answer and cross - petition of the defendant,' <br />and the 'evidence, the plaintiff being present in Court and represented by her <br />attorney, Lloyd W. Kelly and the defendant being present in Court and represented <br />by his attorney, John F. McCarthy, was submitted to the Court and the Court finds <br />generally in favor of the plaintiff and that the facts stated in her petition are <br />true, and she is entitled to a divorce from the defendant and that the cross - petition <br />of the defendant should be dismissed. <br />The Court further finds that the parties hereto were married on the lst day <br />of March, 1932, at Kansas City, Missouri, as in said petition set forth. <br />The Court further finds that the defendant has been guilty of extreme cruelty <br />toward the plaintiff and that plaintiff has given him no cause for his acts. <br />The Court further finds that there is one child affected by this decreer <br />namely, Ronald Clinton Beers, of the age of nine years. <br />The Court further finds that there is community property between the parties <br />hereto consisting of one automobile, money in Postal Savings and furniture, and the <br />Court further finds that the title to the automobile -shall be vested in the plaintiff <br />and that plaintiff be awarded the household furniture. <br />I <br />The Court further finds that the plaintiff's obligations will be to pay the <br />balance on the share of the wash machine and that she be ordered to pay Three Hundred` <br />& No/100 ($300.00) Dollars on the note at- the First National Bank. <br />The Court further-finds that the plaintiff shall pay over to the defendar`t <br />the sum of One Hundred Fifty & No/100 ($150.00) Dollars from the PostalSavings. <br />The Court further finds that the defendant shall pay for the support and <br />maintenance of the minor child, the sum of Twelve & 50100 ($12.50) Dollars per — <br />week. <br />The Court further finds that there are certain items of personal property <br />held by both the plaintiff and defendant and that each should make the exchange <br />so that plaintiff and defendant will have their own personal property, to all of <br />which the plaintiff and defendant except and motionswere filed for a new trial. <br />July 16, 1952. This matter coming on further to be heard upon the motions <br />for new trial, whereupon the Court modified the Order entered on ;March 21, 19523 as <br />follows: That the plaintiff should be gran ted an absolute divorce and that the <br />title to the real estate be quieted in her name and that she have title to the <br />household furniture and the automobile. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the plaintiff <br />is charged with the payment of the account to the Appliance Finance Co. of Grand <br />Island, Nebraska, in the amount of Ninety & No�100 ($90.00) Dollars. <br />
