E A S E M E N T
<br />WHEREAS Max Ewoldt and Viola Gladys Ewoldt, husband and wife,
<br />are the owners and have title to the Northerly Half (2) of'Lot
<br />Ave (5) in Block Twelve (12) in Baker's Addition to the City of
<br />Grand jeland, Hall County, Nebraska, and, Olson and Guy
<br />WFIEREAS Millie R. Johnson, formerly Millie R.
<br />H. Johnson, wife and husband, are the owners and have title to
<br />Southerly Half Off) of Lot Five (5) in Block Twelve (12)
<br />Addition to the City of Grand Island, Hall County, Nebraska, and,
<br />WHEREAS the respective pieces of real property described above
<br />are served by one or more utility lines of either sewer, water or
<br />gas, which enter and cross over one or more of said• pieces of pro-
<br />perty described above for the benefit of one or the other parti-
<br />cular pieces of property, and,
<br />WHEREAS all of the respective owners listed above are desir-
<br />ous of continuing the right of each for such utilities as now exist,
<br />to cross over, through, or under each of their respective lands
<br />for the mutual benefit of all the parties named herein*
<br />NOW THEREFORE, it is agreed for and in consideration of $1.00
<br />and other valuable consideration and receipt of which is hereby
<br />acknowledged; that each of the respective owners named above here-
<br />by grant, assign, bargain and
<br />ell, and set over across other
<br />under
<br />owners named above a perpetual " "
<br />the particularly described lands as set forth above as owned by
<br />each of the respective owners whereby any and all existing utili-
<br />ties such as water, gas and sewer under each respective parcel of
<br />land described above may continue to be used permanently for the
<br />use and benefit of the other premises as they now exist.
<br />IT IS FURTHER AGREED that each respective party hereby agrees
<br />to hold and save harmless the other owners from any and all damages
<br />arising from the use of the right, Basement, as it pertains to
<br />the respective utilities as they now exist, and each agrees to
<br />pay any damage or damages which may arise to the property and re-
<br />place the property in the same condition as they find it, if and
<br />when repairs may be necessary in the fulfillment of these respec-
<br />tive mutual Easements.
<br />This mutual Easement and agreement is binding upon all the
<br />parties, their successors, assigns, eirs, executors, and adsuccessors, dal of 1955.
