4 y <br />AGREEMENT FOR PROTECTIVE COVENANTS, <br />RESTRICTIONS AND CONDITIONS FOR <br />"MORRIS FOURTH ADDITION ", AN ADDITION <br />TO THE CITY OF GRAND ISLAND, NEBRASKA. <br />KNOW ALL MEN BY THESE PRESENTS: <br />MREAS, Clarence Morris, Nettie B. Welch and Marie <br />Morris West, are the owners of all lots in "MORRIS FOURTH <br />ADDITION ", an Addition to the City of Grand Island, Nebraska; <br />and whereas Gladys Morris is the wife of Clarence Morris, <br />Nettie B. Welch is a widow, and Forest E. West is the husband <br />of Marie Morris West; and <br />WHEREAS, it is the desire of the owners of said <br />addition to improve said "Morris Fourth Addition" by encour- <br />aging the sale of lots and the construction of modern houses; <br />NOW, THEREFORE, in consideration thereof, and of the <br />mutual benefits to be derived by the owners of said addition, <br />and any purchaser or purchasers, their heirs, administrators, <br />executors and assigns, each of the owners in his or her own <br />right, stipulate and agree that any and all lots in said addit- <br />ion sold, transferred and conveyed, shall be and are subject to <br />the following protective covenants, restrictions and conditions, <br />all of which run with the land, as follows*# <br />(1) All lots in the addition shall be known and des- <br />cribed as residential lots~ No apartment house, duplex, or <br />triplex shall be built on any lot; no structure shall be erected, <br />altered, placed or permitted to remain on any lots other than one <br />detached single dwelling not to excede two and one -half stories <br />in height and a private garage for not more than three cars, and <br />other secondary buildings incidental to the residential use of <br />the plot. <br />(2) All frame buildings other than the main structure <br />shall have the same quality of `outside wall finish and roof as <br />that approved for residence. No such buildings can be made of <br />unsightly materials, or boxes or similar lumber. <br />(3) All buildings shall be placed at least thirty (30) <br />feet from the front lot line of said lot and on corner lots all <br />buildings shall be at least five (5) feet back from the side <br />street line. Any detached garage or separate secondary structure <br />shall be not less than sixty (60) feet back from the front lot <br />line and on corner lots shall be not less than five (5) feet from <br />side street line. <br />(4) No building or dwelling house shall be moved into <br />said addition and placed upon a lot; no trailer, tent, garage, <br />shack, or other unsightly out - building, shall be used as a dwell- <br />ing at any time, nor shall any structure of a temporary character, <br />nor any basement house, be used as a residence at any time. <br />(5) The ground fl6or area of the main structure ex- <br />clusive of open porches and garages, shall not be less than 800 <br />square feet for a one story or a one and a half story dwelling, <br />and shall not be less than 650 square feet for a two story <br />structure. <br />
