AGREEI,:EN'T AND GRANT <br />It is therefore agreed: <br />1. In consideration of 1.00 and other good and valuable <br />consideration in hand paid by second party to first parties, <br />the receipt of which is hereby acknowledged, first parties <br />hereby give and grant to second party, and to said railroad, <br />the full and free right and authority to use said spur track <br />extending over and across the premises of first parties, and <br />the ground upon which said track is located, and ground adja- <br />cent thereto as hereinafter defined for the purpose of trans- <br />porting and conveying goods and merchandise to and from the <br />premises of second party. <br />2. The part of the premises of first parties subject <br />to this easement shall include the strip of ground on which <br />said spur track is now located as aforesaid together with what- <br />ever ground located north thereof as may be required by said <br />;railroad, or by any valid rules or regulations pertaining to <br />the railroad as a condition to the operation of railroad <br />engines and railroad cars upon and over said spur track, pro- <br />vided however, that this easement shall not extend more than <br />10 feet north'from the north rail of said spur track as now <br />located on the premises as aforesaid, said measurements of <br />10 feet to be made perpendicular to said spur as shown on the <br />attached plat. <br />3. The rights hereby granted shall include the right to go <br />upon the premises included in the easement as aforesaid_ to <br />maintain, repair, and replace said spur tract. <br />4. First <br />partiescovenant and agree that they will not <br />make use of their prremises so as to interfere with the rights <br />and the easement hereby granted, and that in case of a violation <br />by first parties of the terms and conditions of this easement, <br />they will convey to second party without any further consideration <br />the part of their premises subject to this easement by absolute <br />title. <br />L <br />
