AGREEMENT <br />WHEREAS, George W. Lucke and Mary E. Lucke, husband and wife, <br />each in his own right and spouse of the other, are owners of the following <br />described real estates <br />Southerly 80 feet of the Easterly 14 feet of Lot 7, and Southerly 80 <br />feet of Lot 8, Block 125 of Union Pacific Railway Company's Second <br />Addition to the city of Grand Island, Nebraska; <br />and Thomas S. Maloney and Elizabeth Elayne Maloney, husband and wife, <br />and Mary Frances Scott and Sylvester Scott, wife and husband, are the owners <br />of the Northerly 52 feet of the Easterly 14 feet of Lot 7, and the Northerly <br />50 feet of Lot 8, Block 125 of Union Pacific Railway Company's Second <br />Addition to the city of Grand Island, Nebraska, and, <br />WHEREAS the above named owners desire to declare in writing that an <br />easement exists over and upon both the above named premises for utilities, <br />which utilities are now on the premises; and further that in event the owners <br />of either of the above named premises find it necessary to maintain or repair <br />any part of the utilities that might be upon the real property of the other, then <br />such owner or owners shall have the right to go upon the premises of the other <br />for the purpose of maintenance and repair of such utility or utilities. This <br />easement is limited to those now existing on the premises and the right to go <br />upon the premises of the other shall be only for the reasonable maintenance <br />and repair of such utilities. This easement shall run with the land and shall <br />be perpetual. <br />All parties hereto are conversant with the fact that the land second above <br />described is partially occupied by a commercial building, and that it may be <br />necessary from time to time to enlarge, remodel, or repair such building. <br />IT IS MUTUALLY AGREED between the owners of the land respectively <br />described above that the owners of the land first described above will not object <br />to such repair, remodeling, or extension of the premises, so long as such <br />repair, remodeling, or extension does not in any manner encroach on the <br />
