It is mutually agreed that the Tenant may use the premises for any lawful purpose. <br />Should the premises for any reason become untenantable in whole or in part for the purposes <br />of the Tenant, or should all or any part of the premises be condemned or taken by eminent <br />domain, or should all or any portion of the premises be destroyed by fire or the elements, or <br />Abatement for any other cause whatsoever unless such other cause be the negligence of the Tenant, then <br />of Rent rent shall abate justly and equitably during the continuance of such condition, and should <br />such condition apply to all the demised premises or to so great a portion thereof as to render <br />them impracticable for the Tenant's use, then the Tenant may, at its election, cancel this lease <br />and terminate its tenancy as of the date such premises become untenantable or impracticable <br />for use by the Tenant, as the case may be, by giving to the Landlord written notice of its <br />intention so to do. <br />Surrender 7. The Tenant covenants that on the last day of the term or on the last day of a <br />renewal or extension hereof, if this lease is renewed or extended, it will peaceably and quietly <br />leave and surrender the demised premises in as good condition as they now are, ordinary <br />wear and tear, repairs and replacements required to be made by the Landlord, loss by fire, <br />casualty, and causes beyond the Tenant's control, and alterations and improvements herein <br />permitted, excepted. <br />Holdover 8. Should the Tenant hold over in possession after the expiration of the original term <br />or of any extension thereof, such holding over shall not be deemed to extend the term or to <br />renew the lease, but the tenancy thereafter shall continue upon the covenants and conditions <br />herein set forth at the monthly rental rate in effect during the last month of the term, subject <br />to termination by either party by notice designating the date of termination given to the other <br />party thirty (30) or more days before. such date. <br />Possession 9. The Tenant may, prior to the time exclusive possession of the premises is delivered <br />to it, enter any portion of the demised premises to measure, inspect, repair, alter or improve <br />the premises, or to install, display, arrange .or store merchandise or fixtures therein without <br />being deemed by these acts to have taken possession or in any way obligated itself. The <br />Tenant's obligation to pay rent hereunder shall not commence until the Landlord has deliv- <br />ered exclusive possession of said premises to the Tenant and all repairs, alterations and im- <br />provements necessary to fit the premises for occupancy and use by the Tenant shall have been <br />completed. <br />exclusive possession of said premises to the �en until er a evidence <br />of title and consent agreem 13 hereof, all satisfactory to the Tenant, <br />Termination 10.
