STATE OF NEBRASKA ss County of Hall AFFIDAVIT B. J. Cunningham, of lawful age, being first duly sworn upon oath, deposes and says that he is now and for more than 60 years has been a resident and inhabitant of Hall County, Nebraska, and that he is a duly licensed and practicing attor ney -at -law in Grand Island, Hall County, Nebraska. That he was well and personally acquainted with Michael Brennan and in his life time was his attorney and after his death was the administrator of his o.stato._ That he was well and personally acquainted with Mary Moffitt, a cousin of Michael Brennan and the person who filed a petition for administration of the estate of Michael Brennan, deceased, in the County Court of Hall County, Nebraska, and knows that such Mary Moffitt is the same identical person as the Mary Moffitt who by quit claim deed recorded in Book 89 of Deeds at Page 466 of the Deed Records in the office of the Register of Deeds of Hall County, Nebraska, conveyed Lot One (1) in Block Three (3) in Spaulding and Gregg's Addition to the City of Grand Island, Nebraska, to Paul W. Mangelsen and Antionett Mangelsen, and that he knows of his own personal knowledge that such Mary Moffitt, who signed such petition for probate and who executed and delivered such quit claim deed, is the same iden- tical person as the Mary Moffett who is described in the final decree entered by the County Court of Hall County, Nebraska, in the matter of the estate of Michael Brennan, deceased, on the 17th day of May, 1950, notwithstanding the discrepancy in the names in such instruments, the designation of the said Mary Moffitt in such final decree as Mary Moffett being a scrivener's error and mistake.
