& In consideration of the foregoing, Lessor hereby sets over and assigns unto Lessee, with right of Lessee to reassign ,to
<br />others, all of Lessor's license's, consents and permits to maintain and operate a gasoline filling station on the above described premises;
<br />such assignment to be effective only during the term of this lease, and all renewals and extensions thereof.
<br />4. Lessee and any assignee or sub - lessee is expressly given the right at any time.during the term of this lease or any extension
<br />thereof, and for a period of thirty (30) days after the termination of this lease, or any extension thereof, by lapse of time or other-
<br />wise, to enter upon and remove from said premises any improvements or equipment heretofore or hereafter purchased or placed by
<br />it or them upon the leased premises, but shall not be obliged to do so.
<br />5. As a further consideration, Lessor agrees to erect and equip on said premises a service station building to cost not less
<br />than Seventeen Thousand ---------------------- - - -- -- DOLLARS ($ 17,000.gOaccording to the
<br />plans and specifications attached hereto and made a part hereof — consisting of building, work bench, display shelving, desk and
<br />other interior furnishings, mirror, soap and towel dispensers, electrical wiring and fixtures in building, plumbing in building, drain
<br />in lube room, water service, storm and service sewer, and when necessary, sanitary sewer, furnace, duct work, fuel oil storage tank
<br />with pipes and fittings, original installation of light bulbs, grading and sand fill, concrete pad at pump island, inside drives and
<br />approaches, concrete bumpers on pump island pad, landscaping and clean -up work, pump island and yard lighting fixtures installed
<br />and wired, 'to be located on said premises in accordance with the attached plans and specifications, all at the cost of Lessor. Lessor
<br />agrees to begin construction of said building and the installation of said equipment within $' xty___ ( 60 )
<br />days after the execution of this lease and to continue such construction and installation with due diligence until said building and
<br />equipment are completed and ready for occupancy by Lessee, at which time Lessor shall notify Lessee in writing that the premises
<br />are ready for occupancy, it being agreed that said station shall be completed and ready for occupancy on or before Two
<br />Hundred Eighty ( 280 ) days from the date hereof.
<br />6. Lessee agrees to furnish and install building letters, original painting of the entire building, one (1) air compressor, one (1)
<br />hoist, necessary pump and dolly outfits, wiring to and at pump island, wiring to sign, Two ( 2 ) computing pumps,
<br />Two ( 2 ) underground tanks with necessary pipes and fittings for pumps and tanks, and one (1) Standard Oval
<br />Torch sign at Lessee's cost and expense, at such time or times as will conform with Lessor's construction schedule.
<br />7. Lessor will keep the building, driveways, the water pipes, drains and sewers appurtenant thereto and all of Lessor's equip-
<br />ment on the demised premises in good and sufficient condition and repair during the whole of the term hereof. The Lessee shall have
<br />the right to paint the entire building but shall not be obliged to do so, except as provided for in Section 6 above.
<br />8. Lessee shall have the option of extending this lease for a total of not more than Three ( 3 ) successive
<br />periods of rive ( 5 ) years each, upon the same terms and conditions which were in effect during the original term.
<br />The rental to be paid by Lessee during said extension period or periods shall be the sum of Two tundra d r i f. ty -----
<br />DOLLARS ($ 250.00 ) per month.
<br />Lessee shall give to the Lessor written notice of its intention to exercise its extension privilege at least thirty (30) days prior
<br />to the expiration of the original term hereof, and if said extension privilege is for successive periods Lessee shall give to Lessor a
<br />like written notice at least thirty (30) days prior to the expiration of the then current period, of its intention to extend this lease for
<br />and during the next succeeding period. Time and manner of making rental payments during any such extension shall be the same as
<br />provided for during the original term hereof.
<br />9. Lessee shall have, and is hereby given, the option of purchasing said premises, buildings, fixtures, equipment, machinery

<br />($....... �Q,.QaQ'Mi provided Lessee shall give Lessor notice in writing of fits election to exercise said option of purchase at least
<br />thirty (30) days prior to the expiration of this lease, or at least thirty (30) days prior to the expiration of any extension period, if
<br />this lease be extended, it being understood that in no event may this option be exercised prior to.Apri1 18t _1965_
<br />If any part of the demised premises shall be taken by right of eminent domain or by any conveyance in lieu thereof or in connection
<br />therewith, the purchase price'set forth herein, if the purchase option is exercised, shall be reduced in the same proportion that the
<br />area immediately prior to such taking is reduced by the taking. It is further understood that if the Lessor or the Lessor's heirs, execu-
