BY-LAWS OF THEti�MEL�ON TOWNSHIP CEMETERY <br />�� <br />� <br />� <br />� <br />0 <br />� <br />� <br />:� <br />� <br />SECTION I. The Cemetery situated in the Southeast Quarter of the Southeast Quarter of the Southweat Quarter of <br />Section Six (6), Town Nine (9), Range 7welve (12) North, County of Hall, State of Nebraska, shall be dominated se the <br />Shelton Township Cemetery and shall bethe property of Shelton Township, Buffalo County, Nebraska, on the conditions <br />set forth in the Deed conveyfng said Cemetery to Shelton Township, Buffalo County, Nebraska, from the Shelton <br />Cemetery Association. <br />SECTION I I. The Shelton Township Cemetery shall be under the management and control of a Boerd of Trusteea, <br />consisting of three qual Ified electora of the Township of Shelton, who ahall hold their office for a term of three yeare, and <br />until their succeasors are elected and qualified. <br />SECTION I11. At the annual tawn meeting of Sheiton Township held on the fifth day of March, 1818, the electors <br />present shall elect one Trustee for a term of three (3) years, and one to hold his office for a term of two {2) years, and one <br />who shall hold his office for a term of one (1) year, and there shall be elected annually thereafter one Trustee who shall <br />hold his office for three (3) years. Said election to be by ballot, requiring a maJority of all votea cast to constitute an <br />election. <br />SECTION IV. Before entering upon the dutfes of thefr office, each trustee shall take and subscribe to the following <br />oath before the Town Clerk: <br />I ................ do solemnly swear that I wiii support the Constitution of the United States, and the <br />constitution of the State of Nebraska and that I wlil faithfully perform all the duttes impoaed upon me by the state laws, <br />and the by-laws of Shelton township, and especially those laws and by-Iaws governing Shelton township Cemetery. <br />SECTION V. The board of trustees shall meet not later than ten (10) days after the annual Tow�ahip meeting and <br />ahall organize by electing one of their number Chairman, and another o( their number Secretary. It shall be the duty of <br />the Chairman to preaide at all meetings of the board, to sign all deeds and all warrants. It shall be the duty of the <br />secretary to keep a record of all meetings; he ahall also have authority to sell lots, isaue and sign deeds for same, to sign <br />all warrants on the township treasurer, and to coliect all moneys arising from the sale of fots or from any other source for <br />the benefit of the Cemetery, and to pay the same over to the Township Treasurer, taking his receipt therefor. <br />SECTION VI. The Secretary shall before enter(ng upon the duties of his oNice and not later than ten (10) days after <br />his appofntment or election, give bonds for twice the amount of money that is Iiable to come into his handa in any one <br />year, conditfoned upon the faithful performance of his duty as Secretary. The amount of the tronda shall be fixed by the <br />Township Board, who shall approve the said bonda; said bond ahail be ffled with the Township Clerk and shall run to <br />Shelton Township. <br />SECTION VII. All monies arlsing from the sale of lots and from ail other sources for the benefit of the Cemetery <br />shall constitute a Cemetery fund and shall be kept separate from the other funda of the Townahip by the Township <br />Treasurer; and it is hereby made the duty of the Township Treasurer to keep an Itemized account of the rece(pts and <br />expenditures of the Cemetery fund. <br />SECTION VIII. The Township Treasurer la hereby authorfzed to pay ail warrants on the Cemetery fund that are <br />signed by the Chairman and Secretary of the Board of Trustees, to a Ilmit of the funda on hand in said Cemetery fund. <br />SECTION IX. It is hereby made the duty of the electors present at the annual Tovrnship meeting to make a ievy <br />which in thelr Judgment wiil raise sufficent funds to meet the requirements of the cemetery tor the ensuing year. <br />SECTION X. The Trusteea shall have power on behalf of the Townahfp to make all contracts and auperintend all <br />labor done; to direct the expenditure of all money and superfntend all fmprovementa and embellishments of the <br />Cemetery subject only to the will of a majority of the electora preaent at any annual Townahip meeting, and to have <br />general supervision of the Cemetery and the property thereto belonging and to keep the seme in as good repair as the <br />funda wlll permit. <br />SECTION XI. The trustees shall contract no greater expenditures than has been provided for in the Cemetery fund, <br />but the Township Board may, in case of sudden or unexpected emergency, appropriate froal the generat fund of the <br />Township, such sum of money, as in thely discretion shall be neceasary to meet auch emergency, provided the amount on <br />hand in the general fund wfll permit without serious detriment to the other interests of the Township. <br />SECTION XII. The Trustees ahall receive the following compensation for the time in the intereats of <br />Shelton Township Cemetery: the Secretary shail receive the sum of one hundred dollars per annum; the Chatrman ahall <br />recetve the aum of one hundred doliara per annum; the third member of the board ahall r�eive the sum of one hundred <br />dollars per annum plus two dollars per trip for cemetery business. <br />SECTION XII I. The S�retary shall not allow any Intermenta in any unsold lota In the Cemetery, except in that part <br />known as the "Potter's Field", and �o lot shall be sold untll it has been,paid for in cash, or otherwiae to the satiafaction <br />of the Secretary, who shall be responalble for the amount of all sales. <br />SECTION XIV. The Trustees may secure the aervices of a auitable peraon to dig and ffll all graves. The <br />compensation to be paid for this work shail be determined by the Truatees, but said compensation ahall be collected by <br />the grave-digger from the party or partles having the interment made and shall be retained by him as hla total <br />compensation for digging and filling sald grave. <br />SECTION XV. No interment shall be made in Shelton Townahip Cemetery nor shall any grave be digged thereln, <br />until a Burial Permit shall have been obtained from the S�retary of the Board of Truatees. Said permit shall give the <br />name of the person to be buried, the number of the lot, and the name of the owner of said lot as shown by the books of the <br />Secretary. <br />SECTIOPI XVI. Any person may purchase one or more lots in Shelton Townahip Cemetery for the �purpoae of <br />interments, by paying the appraised value of the same as establlahed by the Board of Trustees and complyfng wfth all <br />requirementa of theae by-Iaws that may relate to or govern the sale of lots. <br />SECTION XVII. All vacancies In the office of Truetees ahall.be tilled by appointment by the Townahip Board, and <br />the appointee ahall hold offlce untll the next annual township meeting, when the vacancy shall be filled by electton. <br />SECTION XVIII. At least one haH of all lot salea and at least fifteen dollare from each opening of grave by put In <br />The Perpetual Care Fund. <br />SECTION XIX.
