<br />DEED OF TRUST
<br />THIS DEED OF TRUST is dated March 28, 2012, among DANIEL FOGLAND and CHRISTINE
<br />FOGLAND; Husband and Wife ("Trustor"); Five Points Bank, whose address is North Branch,
<br />2015 North Broadwell, Grand Island, NE 68803 (referred to below sometimes as "Lender" and
<br />sometimes as "Beneficiary"); and Five Points Bank, whose address is P.O Box 1507, Grand
<br />Island, NE 68802-1507 (referred to below as "Trustee").
<br />CONVEYANCE AND GRANT. For valuable consideration, Trustor conveys to Trustee in trust, WITH POWER OF SALE,
<br />for the benefit of Lender as Beneficiary, all of Trustor's right, title, and interest in and to the following described real
<br />property, together with all existing or subsequently erected or affixed buildings, improvements and fixtures; all
<br />easements, rights of way, and appurtenances; all water, water rights and ditch rights (including stock in utilities with
<br />ditch or irrigation rights); and all other rights, royalties, and profits relating to the real property, including without
<br />limitation all minerals, oil, gas, geothermal and similar matters, (the "Real Property") located in HALL
<br />County, State of Nebraska:
<br />All of Lots Five (5), Six (6), Seven (7) and Eight (8), in Block Two (2)' in Kernohan and
<br />Decker's Addition to the City of Grand Island, as said lots and block are laid down and
<br />described on the official plat of said addition. A piece or parcel of land situate in the
<br />northwest quarter of the southwest quarter of Section Sixteen (16), Township Eleven (11)
<br />North, Range Nine (9) West of 6th Principal Meridian, at Grand Island, Hall County,
<br />Nebraska, lying southeasterly a line that is parallel with and two hundred (200) feet distant
<br />northwesterly, measured at right angles from the center line of the original main track of the
<br />Union Pacific Railroad Company (said original main track is the center track of the three
<br />main track of said railroad company as now maintained and operated) and lying
<br />southwesterly of the southwesterly line of Monroe Street in the City of Grand Island, as laid
<br />out and established, being all that part of Block Nineteen (19) of Bonnie Brae Addition of
<br />said City of Grand Island, which was erroneously located, surveyed, staked out and platted
<br />on said Railroad Company's four hundred (400) feet granted right-of-way.
<br />The Real Property or its address is commonly known as 365 N BROADWELL AVENUE, GRAND
<br />ISLAND, NE 68803.
