4 <br /> • <br /> AFFIDAVIT PERTAINING TO LOT FOUR (4), BLOCK THIRTY- <br /> FOUR (34), in .CHARLES WASHER'S SECOND ADDITION TO <br /> THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA <br /> STATE OF NEBRASKA ) <br /> (ss: <br /> • COUNTY OF HALL ) <br /> A. J. Luebs, of lawful age, being first duly sworn, deposes <br /> and says that he is a duly licensed attorney and that he has been <br /> engaged in the active practice of law in the City of Grand Island, <br /> Nebraska since 1927; that the real estate hereinabove described lies in <br /> the incorporated limits of the City of Grand Island in which this <br /> affiant has resided and has been practicing law and that this affiant <br /> has known the circumstances of the ownership and the possession of said <br /> real estate at all times since May 22, 1933, at which time he had been <br /> employed as attorney for the trustees for certain of the depositors of <br /> the Peoples State Bank, Grand Island, Nebraska, said trusteew at that <br /> time being A. W. Necking, Ray.Bottorf, C. I. Cates,"'-Fred Griffin, and <br /> • W. A. Nicholas; that this affiant attended all meetings of said• trustees <br /> and personally-attended to all legal matters pertaining thereto. <br /> • <br /> That' the said trustees acquired title to said real estate by <br /> Receiver's Deed filed May 22, 1933 in Book 74 of the Deed Records of <br /> • Hall County, Nebraska, page 99, said Receiver's Deed being from the <br /> receiver of the Peoples State Bank.of Grand Island, Nebraska; that this <br /> affiant personally knows of his own knowledge and Was personally in <br /> attendance at a certain meeting of the trustees subsequent to May 22, 1933, <br /> at which meeting Ray Bottorf entered his resignation which was then <br /> accepted and that one M. L. Gollaher was appointed as successor trustee <br /> and continued to act as such trustee with the other named trustees to <br /> a tide subsequent to May 6, 1935 when said trustees executed a Warranty <br /> Deed to Paul Jonel, Jr., which was filed by the said Paul Jones, Jr. <br /> on January 20, 1939 and recorded in Book 79 of the deed records of Hall <br /> County, Nebraska, page 376; that this affiant knows of his own knowledge <br /> that the re#ignation of the said Ray Bottorf and the subsequent <br /> appointment of M. L. Gollaher as trustee was made a part of the regular <br /> mtUteis of meetings of said trustee and that the liquidation of• the <br /> assets of said bank has long since been completed and the work of the <br /> trustees terminated and affiant does not now know the whereabouts of such <br /> minbtes4. <br /> ThiS'affiant further states that he is a duly commissioned <br /> Notary Public for Hall County, Nebraska and that he acknowledged said <br /> Warranty Deed from the trustees, including M. L. Gollaher, successor to <br /> Ray Bottorf, conveying said premises to Paul Jones, Jr., as hereinabove <br /> refer'I'ed to, and that subsequently and at the request of the said Paul <br /> Jones, he also, prepared the deed recorded in Book 99 of the Deed Records <br /> of -Hall County, Nebraska, page 566, conveying said premises from Paul <br /> Jones and wife to the present owners, being W. Jess Reinecke and Edna <br /> Reinecke, husband and wife-,--as joint tenants and not as tenants in common <br /> and thst he knows of his own knowledge that the said W.
