Schmidt, husband and <br /> wife, of Grand Island, Hall County, Nebraska, herein referred to as Party <br /> of the First Part, are the owners of a certain tract of real estate <br /> described as the Southerly Eighty Feet (S80') of Lot Five (5), Block <br /> Six (6), in Windolphts Addition to the City of Grand Island, Hall County, <br /> Nebraska; and <br /> WHEREAS, Albert N. Rohweder and Emma Rohweder, husband and wife, <br /> of Grand Island, Hall County, Nebraska, herein referred to as Parties <br /> of the Second Part, are the owners of the Northerly Fifty-two Feet <br /> (N521 ) of said Lot Five (5), Block Six (6), in Windolphts Addition to <br /> the City of Grand Island, Hall County, Nebraska; and - <br /> WHEREAS, certain utilities, including a line for city water has <br /> been installed and are now in existence across the Southerly Eighty Feet <br /> (S801 ) of said Lot Five (5), being the premises owned by First Parties, <br /> for servicing of the residence of the premises owned by Second Parties <br /> and certain other utilities are serviced across the premises owned by <br /> Second Parties for the benefit of the residential building located on <br /> the premises owned by First Parties, including wiring for electricity and <br /> telephone service and possible location of a portion of the sewer line; now <br /> THEREFORE, in consideration of One Dollar by each of the parties <br /> hereto to the other paid and in further consideration of the mutual <br /> promises and benefits herein set forth, it is agreed by and between the <br /> parties hereto that Party of the Second Part shall have an easement <br /> across the premises owned by Parties of the First Part for water service <br /> and such other utilities as are now in existence on said premises of <br /> First Parties and said First Parties shall have an easement across the <br /> premises 'owned by Second Parties for utilities, including telephone and <br /> electric wiring and such other services as may now be in existence, it <br /> being further agreed that in the event any repairs or replacements become <br /> necessary at any time on the premises owned by the other, the cost <br /> thereof shall be paid by the parties benefited by such services. <br /> THIS AGREEMENT shall be binding upon the parties hereto and <br /> the heirs, executors, administrators of the survivor of them, and upon <br /> the assigns of any of the parties hereto. <br /> Dated this .2 Y19-day of April, 1956. <br /> tara2",,V-V 1 P-17,- ; V <br /> h a„r <br /> Parties of the First Part <br /> STATE OF NEBRASKA ) �/Yz'h � / 1 <br /> (ss: Parties of the Second Part <br /> COUNTY OF HALL ��) <br /> On this day of April, 1956, before me, the undersigned, <br /> a Notary Public in ((and for said county, personally appeared Adolph P. <br /> Schmidt and Martha M.
