- - '/' Se _'a.�.'- --- ` -4 '-�t' -sir Y"_ - _- <br /> AGREEMENT FOR PROTECTIVE COVENANTS, <br /> RESTRICTIONS AND CONDITIONS FOR <br /> "PALU SUBDI VISION", A PART OF TBE <br /> NORTHEAST QUARTER (NE4) OF SECTION <br /> THIRTY-THREE (33), TOWNSHIP ELEVEN, <br /> (11) NORTH, RANGE NINE (9), WEST OF <br /> THE SIXTH (6TH) P.M., HALL COUNTY, <br /> NEBRASKA. <br /> KNOW ALL MEN BY THESE PRESENTS: <br /> WHEREAS, Mary Palu, an unmarried woman, and Elvin E. Palu <br /> end Carol Jean Palu, husband and wife, are the owners of all lots <br /> in Palu Subdivision, a part of the NorthEast Quarter (NE*) of <br /> Section Thirty-Three (33) , Township Eleven ( 11) North, Range Nine <br /> (9) , West of the Sixth (6th) P.M., Hall County, Nebraska. <br /> WHEREAS, it is the desire of the owners of said Addition to <br /> improve said Palu Subdivision by encouraging the sale of lots and <br /> construction of modern homes; <br /> NOW, THEREFORE, in consideration thereof, and of the mutual <br /> benefits to be derived by the owners of said Addition and any <br /> purchaser or purchasers, their heirs, administrators, executors <br /> and assigns, each of the owners in his and her own right <br /> stipulate and agree that any and all lots in said Addition sold, <br /> transferred and conveyed shall be and are subject to the following <br /> protective covenants, restrictions and conditions, all of which <br /> shall run with the land as follows: <br /> 1. All lots in the Addition shall be known and described <br /> as residential lots and residences only shall be permitted on <br /> said lots except that secondary buildings incidental to the <br /> residential use of the lot ma;.; be erected under the terms of this <br /> agreement. <br /> 2. All buildings shall have the same quality of outside <br /> wall, finish and roof approved for residential use and no <br /> residence shall be permitted to be erected under a minimum cost <br /> of $6,000.00. No such buildings shall be made of unsightly <br /> materials or boxes or similar lumber. <br /> 4..e.,,23. T-i .5-- r <br /> 3. All residencesishall be placed at a minimum of twenty- <br /> five (25) feet back from the front street line and a minimum of <br /> ten ( 10) feet back from the side lines of said lot. Any detached <br /> garage or other secondar-; structure shall be built on the back <br /> portion of said lots away from the street and tha ll be set no <br /> closer than four (4) feet to the lot lines. <br /> 4. No building or dwelling house shall be moved into said <br /> Addition and placed upon the lot; and no trailer, tent, garage, <br /> shack, or other unsightly outbuilding shall be used as a <br /> dwelling at any time, nor shall any structure of a temporary <br /> character nor any basement house be used as a residence at any <br /> time. <br /> 5. No business or commercial enterprise shall be conducted <br /> in said Addition on any of the said lots. <br /> 6. No animals or livestock exclusive of small pets shall <br /> be kept or maintained in said Addition by any of the owners of <br /> said lots. <br /> 7. All public sidewalks shall be curb sidewalks and the <br /> acceptance of a deed of conveyance by any purchaser or purchasers <br /> of a lot or lots shall amount to approval of such curb sidewalks. <br /> 8. No earth, sand, gravel or trees shall be removed to <br /> the injury of the value or appearance of any lot and no unused <br /> building material, junk or rubbish shall be left exposed, and <br /> s4.? <br />
