AGREEMENT WAIVING REQUIREMENTS OF BULK SALES LAW
<br /> THIS CONTRACT made and entered into upon this 4th day of
<br /> April, 1956, by and between Charles Wheeler, doing business as Diamond
<br /> Garage, Grand Island, Nebraska, and the undersigned, all of whom are
<br /> creditors of said Charles Wheeler.
<br /> WHEREAS, the undersigned creditors of Charles Wheeler, doing
<br /> business as Diamond Garage, Grand Island, Nebraska, are willing to waive
<br /> the inventory and notice under Bulk Sales Law required by Section 36-
<br /> 501,- R. R. S. Nebraska, 19'52, and
<br /> WHEREAS, Charles Wheeler intends to sell and will sell to
<br /> John Priest, purchaser, all of the stock, merchandise, equipment and
<br /> machinery which he has used in the garage business, under the style and
<br /> name of Diamond Garage, 318 North Madison Street, Grand Island,
<br /> Nebraska, and
<br /> WHEREAS, under the provisions of Section 36-501 R. H. S.
<br /> Nebraska, 1952, it is provided that at least five days before the sale,
<br /> trade or other disposition of the stock of merchandise, fixtures,
<br /> equipment or machinery pertaining thereto, other than in the ordinary
<br /> course of business, by the seller to the purchaser, the seller may file
<br /> with the Register of Deeds of the county in which the stock of merchandise,
<br /> or fixtures, equipment or machinery is located, an* agreement with all
<br /> his creditors waiving the inventory and notice required in said section,
<br /> and it is the desire of the seller, said Charles Wheeler, to file
<br /> such agreement with the Register of Deeds of Hall County, Nebraska,
<br /> in compliance with said statute,
<br /> NOW, in consideration of the mutual promises of the parties
<br /> hereto and other good and valuable consideration, it is agreed by
<br /> the creditors, being undersigned hereinbelow, and Charles Wheeler,
<br /> doing business as Diamond Garage, that the creditors waive the inventory
<br /> and notice to creditors required by Section 36-501 R. R. S. Nebraska,
<br /> 1952, being known as the "Bulk Sales Law", and the said creditors of
<br /> said Charles Wheeler, being the undersigned hereinbelow, do hereby
<br /> waive such inventory and notice as required by said law, for the purpose
<br /> of permitting said Charles Wheeler to sell his said garage business,
<br /> including merchandise, fixtures, equipment or machinery, to said John
<br /> Priest, at a sale to be completed at least five days from the date
<br /> hereinafter.
