Cunningham and Balsa L. Cunningham, husband <br /> and wife, Oren E. Cunningham and Urah J. Cunningham, are the owners <br /> of all lots in "Cunningham Subdivision" , an addition to the City of <br /> Grand Island, Nebraska; and <br /> WHEREAS, Oren E. Cunningham, single, and Urah J. Cunningham, <br /> single, are son and daughter of the said William R. Cunningham and <br /> Balsa L. Cunningham; and <br /> WHEREAS, it is the desire of toe owners of said subdivision to <br /> iri >rove said "Cunningham; Subdivision" by encouraging the sale of lots <br /> and tr_e construction of modern hoes; <br /> O:;, ,ERnP0t ., in consideration thereof, and of tree mutual <br /> benefits to be deriver. by Lr_e owners of said subdivision, and any <br /> purchaser or purcaasers, t eir heirs, administrators, executors and <br /> assigns, each of tree owners in r_is and her own right, stipulate and <br /> agree that any and all lots in said sueciivision, sold, transferred, <br /> and conveyed, ahall be and are subject to the following protective <br /> covenants, restrictions and conditions, all of which shall run with <br /> tre land, as follows: <br /> (1 ) All lots in the said subdivision shall be known and described <br /> as residential "A" lots. No apartment. house, duplex, or triplex snail <br /> be built on any lot. No structure shall be erected, altered, placed <br /> or permitted to remain on any iot otubr than one detached. single dwel- <br /> ling not to exceed two and one-half stories in height and a private <br /> garage for not more than three care , and other secondary buildings <br /> incidental to the residential use of tree plot. <br /> (2 ) All frame buildings other than the main structure shall have <br /> the same quality of outside wail finish and roof as that approved for <br /> residence.
