of said Corporation and that he occupied all of the above <br /> described premises until the 11th day of October, 1951 at <br /> which time John L. Paschang was appointed Bishop of the <br /> Diocese of Grand. Island and President of said Corporation <br /> and that he occupied said premises and was in possession <br /> thereof on December 28, 1953, the date on which a lease was <br /> executed to the Sinclair Refining Company which is recorded <br /> in Book 1, at Page 159 of the Deed Records of Hall County, <br /> Nebraska. <br /> Affiant further states that on or about the 1st day of <br /> May, 1931 a Quit Claim Deed was executed for the conveyance <br /> of the above premises to the Diocese of Grand Island, Nebr- <br /> aska but that said Deed was not filed or recorded and that <br /> the same has become lost or mislaid; that the Diocese of <br /> Grand Island has been the owner and in possession of said <br /> premises since April 11, 1917; that at the time said premises <br /> were conveyed to the Diocese of Grand Island there was a mort- <br /> gage on said premises to the Nebraska Loan and Trust Company <br /> of Grand Island, Nebraska, in the sum- of $7,500.00; that said <br /> mortgage was paid to the Nebraska Loan and Trust Company of <br /> Grand Island, Nebraska on or about July 10, 1937 out of funds <br /> belonging to the Diocese of Grand Island, said payment was <br /> made by this affiant for S. V. Bona, then Bishop of the Diocese <br /> of Grand Island, Nebraska; that the Diocese of Grand Island, <br /> Nebraska has been in absolute, exclusive, open and adverse <br /> Possession of said premises under claim of absolute ownership <br /> at all times from March 23, 1917 up until December 28, 1953; <br /> that no person, corporation, individual or group of persons <br /> has ever made, asserted or claimed any right, title, claim <br /> or interest in or to any part of the above described premises <br /> as against St. Mary's Church or the Diocese of Grand. Island, <br /> or either of them. <br /> -2- <br />
