(2) <br /> leasehold estate hereby created, and upon the reversionary estate of said premises <br /> during the term hereby ranted, and so long thereafter as said lessees, successors <br /> and assign, heirs or devisees shall occupy' said demised premises, in excess of the <br /> amount of 1953 real property taxes levied and assessed upon said tot No. 11, unless <br /> it is specifically provided that such excess in taxes is included in any rental as <br /> fixed for any of the succeeding five-year periods; it being the understanding that <br /> the Trustee Lessors, or Successor Lessors, as the case may be, or their heirs or <br /> devisees or assigns, shall at no time during the term of this lease pay any amount <br /> for taxes of any kind upon the real property herein leased in excess of the dollars <br /> amount of the 1953 real property taxes thereon, except where in writing stipulated <br /> as having been included in any adjustment in rentals. In arriving at such additional <br /> real property taxes on said lot, the same shall be computed on the basis of a fair, <br /> pro•rata share of the total increase that said lot bears in area to the entire tract <br /> included in such taxed unit. <br /> At the termination of this lease, lessees shall have the privilege of removing <br /> such improvements as shall b e placed on said leased premises by lessees, the obligee <br /> tion remaining with lessees however to restore said premises to their original con- <br /> dition. <br /> Lessees further agree to regularly and promptly pay all taxes levied and assessed <br /> against the improvements placed on said leased property during the term of this <br /> lease, together with any assessments or public charges hereinafter made and a sseesed <br /> upon this lease. This, however, shall not include any liability for the pent of <br /> taxes, assessments or other charges imposed by State or Federal Laws from the income <br /> of lessors or upon the passing of any';interest in the leased premises ;enerally known <br /> as "income" or "inheritance", "legacy", "succession" or "estate" taxes, these being <br /> liabilities of the lessors or some of them. Nothing in this lease shall be construed <br /> as preventing or interfering with the contesting of lessees at lessees' own expense <br /> of any liens, claims or charges of any kind in respect to the promises herein leased <br /> which may be thought by lessees to be unlawful or excessive, and lessees upon first <br /> furnishing to lessors after lessors' requiring the sauce, reasonable security for the <br /> payment of all liability, cost and expenses at the end of the litigation, may so con-. <br /> test the same. <br /> During the term of this lease lessees agree to conform to and observe all the <br /> rules end regulations pertaining to all leased premises around this lake area and that <br /> the same will be used only for residential purposes and that lessees will not during <br /> ouch term permit the same to be used for any illegal or unlawful purpose, business <br /> or occupation; that all garbage shall be removed from the leased premises as often <br /> as sanitary conditions require; that no dog or dogs will be permitted on the leased <br /> premises either by lessees, their family or guests; that this lease is not assignable <br /> without wtitten consent of lessors, which will not be unreasonable withhold, that any <br /> attempt to assign without such permissionshall operate to avoid the lease at the <br /> option of lessors, and lessees acknowledge that lessors shall have the right to make <br /> suitable and reasonable rules for conduct on the premises and for the convenience and <br /> guidance of the various tenants about the lake and hereby expressly agree to abide <br /> by such rules and regulations. <br /> Lessees further agree forthwith to oonstruct upon the leased premises a building <br /> adapted for residential purposes at a fair and reasonable cost of not less than <br /> $25,000.00 , and further agree that the structure shall Include ude sanitary Plumbing <br /> proper facilities for sewerage disposal; that lessees will thereafter during the term <br /> of this lease have and keep upon the leased premises, except during any period re- <br /> quired for reconstruction, a building of the character and cow of construction above <br /> provided for, and will at all times have and keep such building in good condition <br /> and repair, except as a sinst loss or damage by fire or other casualty, and in case <br /> of such Loss or damage will with reasonable dispatch by suitable repairs or recon- <br /> struction restore the same to the condition it had or &mould have had before such <br /> casualty. <br /> Lessees assume all risks of damage to lessees, lessees' family, agents and =_ <br /> guests, and lessor Shall be in no way liable for accident, damages or injuries of <br /> 1rn <br /> r. ,.�a� _�_ L <br />
