CONTRACT AVD AGREE^:TIT <br /> THIS AGRE e.ENT made and entered into this day of <br /> __April_ _, l9 c�5 _, by and between Rudolph I , Kue star and The <br /> First National Bank of Grand Island, Nebraska, as Executors and <br /> Trustees under the Will of Richard ii. Kuester, deceased, for and <br /> during the lifetime of Elsie Kuester, and no longer, as Trustee <br /> Lessors; and Rudolph N. Kuoster and Frances Kuester, his rife, <br /> Grand Island, Nebraska, as Successor Lessors, hereinafter referred <br /> to as lessors; and <br /> William and Catherine M. Shaver and or tie. <br /> Of Grand Island, Nebraska, =o aska, as lessee, hereinafter referreds - <br /> ITNESSE'TH: lessee, <br /> That for and in consideration of the covenants and agreements <br /> as hereinafter set forth, the parties hereto agree as follotra: <br /> WIEBEAS, this indenture evidences the grants, covenants and <br /> agreements nor made by and betvoen the parties with reference to <br /> the following described premises, to-wit ; <br /> The East Half of the Southwest Quarter (E4SW ) <br /> of Section Thirteen (13) in Township Eleven <br /> ( 11) North, Range Nine (9) West of the 6th r.:i, , <br /> in Hall County, Nebraska, <br /> on which is located a lake and in connection with which certain <br /> lots abutting the same have been marked off and identified by <br /> certain stakes and are of various lake-front footage, and which <br /> lots are identified by numbers both marked upon the stakes indi- <br /> cating the location and upon the chart in the possession of <br /> lessors or some of them, and to which lots access is gained <br /> from the public highway running along the South side of said <br /> Section Thirteen (13) by roadways constructed and maintained by <br /> lessors running along the rear of such lots; and <br /> • WHEREAS, lessee now occupies under lease with said lessors <br /> • Lot No , having a lake-front footage of _50_ feet <br /> situate on the __gg e_g '_yireat portion of said <br /> lake above me=ntioned; <br /> • NO7 THEREFORE, in consideration of the promises and the <br /> rental hereinafter provided, the Trustee Lessors have leased <br /> unto lessee and lessee leases from such Trustee Lessors commenc- <br /> ing *nay 1„ __ _)-955_, and terminating on the day death of <br /> said Elsie ICu s t .;r, and the Successor Lessors do hereby lease <br /> unto lessee and lessee leases from the Successor Lessors, commenc- <br /> ing on the day of death of said Elsie Kuester, and terminating on <br /> the 10 day of __duly 20 it being understood by all <br /> parties that effective 195c , this agreement super,' <br /> sodas and terminates any and-ail leases i!orw in effect between the <br /> parties hereto with reference to the above described premises <br /> heretofore in effect between the parties hereto; <br /> Lessee hereby agrees to pay as rental for said above described <br /> leased premises the sum of __.RSP�.ngm- .lQ, oeni per lake- <br /> front foot annually, or a total of _ year, in <br /> advance on the first day of July of each year, commencing a, ly <br /> ____, ___19 „�, which rental shall continue for a period of <br /> __jail__ years from July 1 1955 ,, and to be paid at <br /> such place or places from time too time as designated by the Trustee <br /> Lessors or Successor Lessors as the case may be; <br />
