AGREEMENT <br /> This agreement made and entered into this 12th day of <br /> October, 1955, by and between Augusta Wiseman, hereinafter, referred to as <br /> first party and John Niedfelt and Albert Niedfelt, or the survior of them jointly <br /> and not as tenants in common, it being the intention of John Niedfelt and Albert <br /> Niedfelt that in the event of the death of either of them the entire rights under <br /> this agreement shall be in the survivor, said John Niedfelt and Albert Niedfelt <br /> being hereinafter referred to as second parties, as follows: <br /> 1. The first party hereby sells, assigns, and sets over to the second <br /> parties all sand, gravel, road materials and other minerals, not, however, in- <br /> cluding any petroleum rights, located on or beneath the following described real <br /> property: <br /> An irregular tract of land situated in Lot One (1) on the Right or Southerly <br /> bank of the North Channel of the Platte River in Section 329 Township Ten <br /> North (T 1-0 N), Range Eleven West ($ 11 Wf of the 6th P. M. Hall County, <br /> Nebraska, more particularly described'as follows: Beginning at a point <br /> being located 300. 0 Feet West of the Southeast corner of said Section 32, <br /> running thence West along and upon said South Line a distance of 623. 0 <br /> Feet, running thence North at Right Angles a distance of 133. 0 Feet, <br /> running thence Northeasterly to a point 835. 0 Feet North and 233. 0 Feet <br /> West of t&ie Southeast corner of Section 32, running thence East a <br /> distance of 233. 0 Feet to a point on the East line of Section 32, running <br /> thence South along and upon said East line a distance of 460. 0 Feet, <br /> running thence Southwesterly a distance of 488. 8 Feet to the point of <br /> begirziing, and containing 10 Acres more or less not including the <br /> Public Road Right-of-way along the East and South sides of said Tract. <br /> The right of possession of the above premises for the purpose of remov- <br /> ing the materials above set out shall be in the second parties from the date of <br /> the execution of this agreement to the termination thereof, such termination <br /> being specifically hereinafter set out. The second parties shall have the right <br /> to ingress and egress over the premises at all times, and the right to remove <br /> the materials hereinafter set out in the manner commonly employed for such <br /> removal. <br /> During the term of this agreement the first party shall have the right to <br /> the use for pasture purposes of such part of the premises not then being used <br /> by second parties at the time, and also the right to remove water from the lake <br /> which may be established, for the purpose of irrigating other lands owned by <br /> first party in the same section. In event first party desires to use any part <br /> 4 7 <br />
