EASEMENT AND AGREEMENT <br /> This Agreement made and entered into by and between James B. Kellogg <br /> and Emelia T. Kellogg, husband and wife, each individually in his and her <br /> own right and. as spouse of the other, of Hall <br /> County, Nebraska, hereinafter known as the "Grantor s " and Northwestern Public <br /> Service Company, a Delaware Corporation, Huron, South Dakota, hereinafter known <br /> as the "Grantee" <br /> WITNESSETH: <br /> WHEREAS the Grantors are the owner s of the following <br /> described tract of real property situated in J-I 11 County, <br /> A tract of land commencing at a point 134 feet north of the <br /> Nebraska: southeast corner of the Southeast Quarter of the Northeast 4uar- <br /> ter (SEA-NE-4) of Section Thirty-three (33) , Township Eleven ( 11) North, Range wine <br /> (9) West of the 6th P. M. in Hall County, Hebraska, thence in a westerly direction <br /> to the West line of said Southeast Quarter of the Northeast Quarter (SE4NEn) tnence <br /> in a northerly direction along said west line a distance of 132 feet, thence in an <br /> Easterly direction parallel with the South Line of said Southeast Quarter of the <br /> Northeast Quarter ( SE4NE4) above described, to the East line thereof, thence in a <br /> southerly direction 132 feet to the place of beginning containing three acres, <br /> a little more or less, and <br /> WHEREAS the Grantee is desirous of laying and. installing a gas main <br /> or mains and equipment to run approximately North and South <br /> through the East side of said tract of land at a point approximately <br /> forty-two feet West of the East boundary line of <br /> said tract. <br /> NOW THEREFORE for and in consideration of the sum of One Dollar ($1.00) <br /> in hand paid by the Grantee to the Grantor s , the receipt of which is hereby <br /> acknowledged, the said Grantors for themselves their <br /> heirs, executors, administrators, successors, lessees, and assigns do <br /> hereby give and grant unto the Grantee, its successors, lessees, and assigns, a <br /> perpetual easement and right of way through, along and across a strip of land <br /> six feet wide in the following described tract of land situated in <br /> tract of land commencing at a point <br /> Hall County, Nebraska: 132 feet north of the southeast cor- <br /> ner of the Southeast Quarter of the Northeast Quarter (SE4NE4) of Section Thirty- <br /> three (33) , Township Eleven ( 11) North, Rance Nine (9) :lest of the 6th P.
