EASEMENT FOR ELECTRIC 1-0WER LINE
<br /> KNOV ALL MEN BY THESE cRESOKTS, that we, Kenneth 7. rains and Inez
<br /> Stowe Rains, husband and wife, each in their own name and ri;-bt and as the
<br /> spouse of each other, in consideration of the sum of One Dollar, tc us in :hand
<br /> paid by the City of Grand Island, a Municipal Corporation, of Grand. Island,
<br /> Hall County, Nebraska, the receipt whereof is hereby acknowledged, do hereby
<br /> grant unto said City of Grand Island, a Municipal Corporation, its successors
<br /> and assigns, a permanent right of way, privilege and authority tc construct,
<br /> operate and maintain its line for the transmission of electrical energy, H
<br /> including the necessary poles, wires, guys, stubs and other fixtures, over,
<br /> across and upon the following described real estate, now owned by us in
<br /> Hall County, Nebraska, to—wit:
<br /> being astrip of land approximately 8 ft. wide and
<br /> 11039.1 ft. in length, described as: Commencing at
<br /> a point in the West Half of the :'rest Galf of Section
<br /> 4, Township 11, Range 9, 169 feet East of the point
<br /> of intersection of the West line of said section with
<br /> the North line of Roberts Avenue in Rains Addition to
<br /> the City of Grand Island, and proceeding in a Northerly
<br /> direction parallel to the Vest line of said section, to
<br /> the West line of said section, to the intersection with
<br /> the Northerly line of said section, thence along said "+
<br /> Northerly line a distance of eight feet, thence in a :'
<br /> Southerly direction in a line parallel to the "lest line
<br /> of said section to the point of intersection with the
<br /> North line of Roberts Avenue, in Rains Addition to the t:`
<br /> City of Grand Island, thence along said North line of r'
<br /> Roberts Avenue a distance of eight feet, to the point
<br /> of beginning.
<br /> Said poles, wires, guys, stubs and other fixtures, to he placed in
<br /> such manner as to extend outside the boundaries of the above described area,
<br /> and we also hereby grant unto said company, its successors and assigns, the
<br /> right, privilege and authority to trim, or cut doom, any trees which may
<br /> interfere with the construction, maintenance and operation of such lines,
<br /> and, do also grant unto said company, its successors and assigns, the right ;a
<br /> to enter upon the above described premises at any and all times for the
<br /> purposes above set forth. The City of Grand Island, a Municipal Corporation,
<br /> shall pay any and all taxes upon said line and fixtures and shall pay such
<br /> damage to crops as may be caused by the negligence of said City of Grand
<br /> Island, a municipal corporation, or its employees. It being the intention
<br /> of the parties hereto that the City of Grand Island, a municipal corporation,
<br /> shall not be liable for ordinary damage caused by entry upon the above described
<br /> premises for purposes of construction, repair, or inspection.
