AGREEMENT FOR RESTRICTIONS <br /> IN "WETZEL'S SUBDIVISION" <br /> OF A PART OF THE SOUTHEAST QUARTER OF. THE SOUTHEAST QUARTER <br /> OF SECTION ELEVEN IN T0INSHIP ELEVEN NORTH, RANGE NINE <br /> WEST OF THE 6TH P.M. IN HALL COUNTY, NEBRASKA <br /> WHEREAS, C. G. Wetzel is the owner of all Lots located in "Wetzel's Subdivi- <br /> sion" of a part of the Southeast Quarter of the. Southeast Quarter of Section <br /> Eleven in Township Eleven North, Range Nine West of the 6th P.M. in Hall County, <br /> Nebraska, and is a widower, now unmarried, and <br /> WHEREAS, it is the desire of the aforesaid owner of the above described <br /> "Wetzel's Subdivision" to sell the Lots in said Subdivision to purchasers who <br /> will construct modern.and desirable dwelling houses thereon, and whereas the <br /> owners and prospective owners of said Lots desire to have certain restrictions <br /> made in the sale of said Lots, <br /> NOW, THEREFORE, in consideration of the mutual benefits to be derived by the <br /> owners of said "Wetzel's Subdivision" and any purchaser or purchasers, their <br /> heirs, administrators, executors and assigns, it is hereby stipulated and agreed <br /> that the Lots in said Subdivision shall be sold, transferred, and hereinafter <br /> conveyed subject to the following restrictions and conditions, to wit: <br /> 1. Lots 1 to 21L inclusive shall be known and described as Residential Property, <br /> and used and sold only for residential purposes. <br /> 2. No building shall be moved into said Subdivision or be placed on any Lot <br /> thereon, without the owner of such Lot first procuring the written consent <br /> of all owners of all Lots in said "Wetzel's Subdivision". <br /> 3. No building shall be erected nor placed on any of the Lots in said Subdivision, <br /> closer than twenty-five feet from the front of the Lot on which such building <br /> is to be erected or moved, front meaning the side of the Lot facing the pub- <br /> lic road running North and Souththrough said Subdivision. <br /> I . No basement, tent, shack, garage, barn or other outbuilding placed upon or <br /> erected on any of the Lots in said "Wetzel's Subdivision" shall at any time <br /> be used as a residence, temporarily or permanently. <br /> 5. No dwelling costing less than $7,000.00 shall be permitted to exist on any <br /> of the Lots in said Subdivision. <br /> 6. No trailers shall be permitted to be placed upon or moved upon any of said <br /> Lots in said Subdivision for the purpose of residing therein.: <br /> 7. No cattle, sheep nor swine shall be kept or be maintained on any of the <br /> premises in said Subdivision. <br /> 8. Every dwelling erected on any of the Lots. in said Subdivision or moved thereon <br /> shall be connected with an adequate and healthful sewerage disposal system <br /> and septic tanks to be kept in a safe and sanitary condition at all times by <br /> the respective owners thereof, such septic tanks and sewerage disposal sys- <br /> tem shall be located more than ten feet inside any Lot line on which another <br /> Lot abuts such Lot in said Subdivision. No cesspools whatsoever shall be <br /> constructed upon nor be maintained at any time upon any of the Lots in said <br /> Subdivision. <br /> 9. These covenants are to run with the land and shall be binding on all parties <br /> and all persons claiming under them and all purchasers of any of said Lots <br /> until January 1, 1980, at which time said covenants shall be automatically <br /> extended for successive periods of ten years each, unless by vote of a majority <br /> of the then owners of record of the Lots in said Subdivision, it is agreed to <br /> change said covenants in whole or in part, which changes shall not be effective <br /> until they have been agreed to in writing by such majority of the then owners <br /> of said Lots and have been filed for record in the office of the Register of <br /> Deeds of Hall County, Nebraska. <br /> • <br /> • <br /> 3 <br />
