• <br /> STATE OF NEBRASKA ) <br /> (SS: AFFIDAVIT <br /> COUNTY OF HALL ) <br /> WISE STEWART, being first duly sworn on his oath, <br /> deposes and says that he signed an Agreement with Joe H. <br /> Struebing and Shirley M. Struebing of Grand Island, Nebraska <br /> which is hereto attached marked Exhibit and made a part <br /> hereof, said Contract being dated August 15, 1952. <br /> Affiant further states that the said Joseph H. Strue- <br /> bing and Shirley M. Struebing completed the purchase of the <br /> of said Agreement <br /> premises referred to in the fourth paragraph/and that said pre- <br /> mises described as Lot One Hundred Fifty-seven (157) in Buena <br /> Vista Subdivision, an Addition to the City of Grand Island in <br /> Hell County, Nebraska; that under the terms of said Contract <br /> the said Joseph H. Struebing and Shirley M. Struebing agreed <br /> to execute a mortgage to affiant, Wise Stewart; that they have <br /> failed and neglected to execute said mortgage and that this <br /> affidavit and Contract are being recorded in accordance with <br /> the Provisions of said Contract dated August 15, 1952 and that <br /> under said agreement said Joseph H. Struebing and Shirley M. <br /> Struebing were to execute a mortgage on said premises and that <br /> the affiant herein, Wise Stewart, claims a lien upon said pre- <br /> mises for the amount due under said Contract, to-wit: Eight <br /> Hundred Fifty Three and 70/100 Dollars (8853.70) with interest <br /> at eight (8) per cent from August 15, 1952. <br /> Subscribed and sworn to before me this this day of <br /> July, 1954. ..-T <br /> y��J LI C <br /> l <br /> My commission expires: �/ J /X r/ (' <br /> A, N <br /> � .'
