<br /> I, Herbert F. Mayer, being first duly sworn on my oath.depose and say
<br /> that I am a resident of Grand Island, Hall County, Nebraska, and have been such for
<br /> more than fifty-one years last past; that I personally well know the real estate
<br /> more particularly described as:
<br /> •
<br /> Fractional.Lot Four (4) in Fractional Block One Hundred
<br /> Sixteen (116) in Railroad Addition to the City of Grand
<br /> Island, Nebraska, and its complement, to-wit: Fractional
<br /> Lot Four (4) in Fractional Block One Hundred Sixteen (116)
<br /> in Koenig and Wiebet • Addition to the City of Grand Island,
<br /> Nebraska;
<br /> that said real estate is located directly across the street to the South from the
<br /> former.home of my grandparents and that I have personally well known the owners of
<br /> said real estate above described for more than forty-five years last past; that
<br /> said above described tract is in truth and in fact a rectangular tract of ground
<br /> extending 66 feet in an easterly and westerly direction on the South side of West
<br /> First Street in Grand Island, Nebraska, and 132 feet northerly and southerly on
<br /> the East side of Clark Street in Grand Island, Nebraska; that said tract is in
<br /> truth and in fact and at all times for more than fifty years last past has been a
<br /> rectangular tract more particularly described as follows:
<br /> Commencing at the northwest corner of Fractional Lot Four
<br /> (4) in Fractional Block One Hundred Sixteen (116) in Rail-
<br /> road Addition to the City of Grand Island, Nebraska, being
<br /> the point at which the southerly line of First Street inter-
<br /> sects the easterly line of Clark Street, running thence
<br /> easterly along; and upon the northerly line of said Fractional
<br /> Block One Hundred Sixteen (116) in Railroad Addition to the
<br /> City of Grand Island, Nebraska, which is also the southerly
<br /> line of said First Street, a distance of 66 feet, turning
<br /> thence southerly at right angles and running a distance of 132
<br /> feet parallel with the easterly line of said Clark Street to
<br /> the northerly line of the public alley abutting said premises
<br /> to the South, turning thence westerly at right angles and running ---
<br /> along and upon the northerly line of said public alley a dis-
<br /> tance of 66 feet to the easterly line of said Clark Street,
<br /> turning thence northerly at right angles and running along
<br /> the easterly line of said Clark Street a distance of 132 feet
<br /> to the point of beginning, all as more particularly shown by
<br /> the plat hereto attached and made a part hereof, dated June
<br /> 10, 1954, and signed and certified to by E. H. Cordes, City
<br /> Engineer, who is the City Engineer of the City of Grand
<br /> Island, Nebraska;
<br /> that at all times during the past fifty years said pranises have been such rectangular
<br /> tract hereinbefore more particularly described and that daring said fifty years last
<br /> past I positively know of my own personal knowledge that George J. Candish owned
<br /> and occupied said entire rectangular tract up to the date of his death on September
<br /> 5, 1932, and that thereafter his widow Addie Ellen Candish owned and occupied all
<br /> of said rectangular tract openly, notoriously and exclusively, claiming to be the
<br /> sole owner thereof as against all other persons whomsoever from. the 5th day of Septem-
<br /> ber, 1932 to the 314 day of May, 1948, and since the 3rd day of May, 1948, up to the
<br /> time of making this affidavit, Paul C. Candish, Sr., and H. G. Candish have been the
<br /> sole and exclusive owners of said real estate and are now the owners of record thereof,
<br /> and are in full and complete possession of each and every part of said rectangular tract
<br /> hereinbefore more particularly described which tract is one and the same and identical
<br /> to and with the tract as surveyed by said E. H. Cordes above mentioned and is the
<br /> plat thereof hereto UU /ched as above stated;
