<br /> -WHEREAS, the parties hereto_I ve entered into an -agree-
<br /> Went, _through Flower-Evans -Company,-_---of Grand- Island, Nebraska,
<br /> for the sale_by the Sellers to the -Buyers of the property described
<br /> as the Southerly-One-Half (Si) of Lets Four (4)- and Five (-5) , in
<br /> Block Sixty-one (61)-, in Wheeler & -Bennett'_s Second Addition to
<br /> the City of Grand. Island, Nebraska, and=-the parties_ hereto desire
<br /> to enter_into an agreement regarding. a sewer easement on said property;
<br /> NOW, THEREFORE, if considerati-on of the sale-=f the -
<br /> acove described proerty and their mutual promises and covenants,
<br /> it is hereby mutually agreed by and between the parties hereto,
<br /> as follows, to-wit: _
<br /> 1_ Sellers reserve a-perpetual easement acrd-as -said
<br /> above described nropert=; for the operation, maintaainance,_ -repairs,
<br /> serv_cing and replacement o f asewer: line across said property.
<br /> S. _ In the event that such operation, maintainance, re-
<br /> pairs, servicing and replacement on Said sewer line require dig-
<br /> _ing up said sewer line, Sellers reserve the right to have such
<br /> work done, but agree that all -expenses _shall be at the Sellers'
<br /> cost, and that all actual damages to Buyers resulting therefrom
<br /> shall be Paid to the Buyers by the Sellers, and, further, that
<br /> they will have such work done at reasonable times and at a-mini-
<br /> mum of damage or inconvenience to the -Buyers. - The Sel l-ers fur-
<br /> ther agree that they will also hold and save the Buyers harmless
<br /> - from any and all other damages arising from the use of -such-_ease-
<br /> ment for- said sewer line and Sellers agree to pay any. and -all
<br /> -dam-laces caused by -or arising -from. same.
<br /> 3. This easement shall run With the- land -and shall- be
<br /> binding upon the heirs, executors, administrators and assigns--of
<br /> the parties hereto, including all future owners of said premises
<br /> above de scribed.
<br /> 4. This instrument sets forth the _entire--agreement of
<br /> the parties hereto and shall not he _M ied or changed, -except by
