• <br /> AFFIDAVIT <br /> STATE OF NEBRASKA ) <br /> • <br /> )ss. <br /> COUNTY 07 HALL ) <br /> Vernon Rice, being first duly sworn on his oath, deposes and says, <br /> as follows, to wit: <br /> That he well remembers one certain transaction upon which occasion <br /> William Kruse and Minnie Kruse, husband and wife, sold the property later <br /> described herein to Lester Morse and Esther'Nay Morse. <br /> That on said occasion, the day of October 20, 1947, the said <br /> William Kruse and Minnie Kruse advised him that they intended to convey <br /> to the said Lester Morse and Esther May Morse a five acre tract situated <br /> in the southwest quarter of Section Three (3) in Township Eleven )11) <br /> North, Range Nine (9) West of the 6 th p. M. , Hall county, Nebraska, and <br /> provided him with a meets and bounds description composed of measurements <br /> in feet comprising said tract and that no other measurements other than <br /> in feet were stated therein. <br /> That in the preparation of the deed comsummating said transaction <br /> on said date of October 20, 1947, which deed was acknowledged before him <br /> on said date and which was later filed of record on October 24, 1947, in <br /> Book 91 at page 463 of the deed record in the office of the Register of <br /> Deeds of Hall county, Nebraska,, the scrivner, through clerical error, failed <br /> to set out that the last three measurements in the legal description were <br /> measurements in feet but that he knows of his own knowledge that such <br /> measurements were intended to be in feet, along with all other measurements <br /> in said legal description, and that the correct description of the property <br /> conveyed by said deed is as follows: <br /> commencing at a point 452.8 feet west of the center of the <br /> Omaha and Republican valley Railroad now known as the Ord Branch <br /> of the Union pacific Railroad company, and the Northeast corner <br /> (NE) of the North Twelve (12) Acres, more or less, of the south <br /> Thirty Two (32) acres of that part of the Southwest Quarter (s4) <br /> of section Three (3) in Township Eleven (11) North, Range Nine <br /> (9) West of the 6th p.
