/ oZ - <br /> (6) All public sidewalks shall be curb sidewalks; and <br /> the acceptance of a deed of conveyance by any purchaser or pur- <br /> chasers of any lot, lots or fractions thereof, shall be and <br /> amount to and be construed as consent thereto, and approval of <br /> such curb sidewalk. <br /> (7) No sod, earth, sand, gravel, or trees shall be re- <br /> moved to the injury of the value of or appearance of any lot, <br /> and no unused building material, junk or rubbish, shall be left <br /> exposed on said lot except during actual building operations. <br /> (8) No worn out or discarded automobiles, machinery <br /> or parts thereof, shall be stored on any lot in the addition, <br /> no portion thereof shall be used for automobiles, junk piles, <br /> or storage of any kind of junk or waste material. <br /> (9) These covenants, restrictions and conditions are <br /> to run with the land and shall be binding on any persons and <br /> all parties claiming ownership of said lots for a period of ten <br /> years (10) from date hereof, at which time said covenants, <br /> etc. shall be automatically extended for successive periods of <br /> ten years (10), unless changed or modified by a vote of the <br /> majority of the then owners of the lots of said addition. <br /> (10) If any owner of any lot, or their heirs or <br /> assigns, shall violate or attempt to violate any of the coven- <br /> ants, restrictions and conditions herein set forth, it shall be <br /> lawful for any other person or persons owning any real estate, <br /> in said addition to prosecute such proceedings at law or in <br /> equity against the person or persons viol tang or attempting <br /> to violate any such conditions, covenants, etc, and to prevent <br /> him from so doing or to recover damages for such violation. <br /> (11) If any of the covenants, restrictions or condit- <br /> ions herein set forth are violated and declared void by a court <br /> of competent jurisdiction, the remaining covenants, restrictions <br /> and conditions shall not be affected but shall stay in full force <br /> and effect. <br /> (12) This agreement and the faithful performance of <br /> the terms thereof shall be binding upon heirs, administrators, <br /> executors, assigns, grantees, and devisees, of the parties to <br /> this contract, and upon the purchaser or purchasers of any lot <br /> or lots in said "Morris Third Addition." <br /> Rip WITNESS WHEREOF, we have hereunto set our hands <br /> this Az day of March, 1954. <br /> 66/U./Pt rence Morris <br /> Agi <br /> C <br /> Gladys Moor�rr <br /> .... i= , wife of Clarence/ � <br /> Morris <br /> Nettie Bye elch, widow <br /> d°24E-4,--A <br /> Marie Mo <br /> rris West <br /> ff't (bi-49'West, <br /> husband of Marie Morris West <br />
