• <br /> SUPPLEMENTAL AGREEMENT <br /> This Supplemental Agreement made and entered into this /74 <br /> day of March, 1954, by and between H. B. JOHNSON and FLORENCE A. JOHNSON, <br /> Lessors, herenafter referred to as First Parties, and M. M. LIPPINCOTT, <br /> Lessee, hereinafter referred to as Second Party, WITNESSETH: <br /> WHEREAS, under date of March 4, 1952, the parties hereto <br /> entered into a Contract and Lease Agreement whereby and by the provisions <br /> of which the parties of the first part leased to party of the second <br /> part the gasoline filling station located on Highwa.jr. 30 adjacent to the <br /> Shamrock Cafe together with certain privileges within the cafe itself <br /> and the right to use certain driveways as therein more fully set forth <br /> and which filling station is located toward the southwesterly portion <br /> of the premises therein described, which premises were described as <br /> follows, to-wit: <br /> Commencing at a point Fifty (50) Feet South and Thirty- <br /> Three (33) Feet East of the Northwest Corner of the North- <br /> west Quarter of the Northwest Quarter (NW4NW4) of Section <br /> Thirty-Four (34), Township Eleven (11), North, Range Ten <br /> (10), West of the 6th P.M., and running thence South parallel <br /> with the West line of said Northwest Quarter of the North- <br /> west Quarter (NW4NWg) of said Section Thirty-Four (34) to the <br /> Right-of-Way line of the Federal Highway No. 30 running <br /> thence Northeasterly along the right of way line of the <br /> Federal Highway to the Southwest corner of a tract deeded <br /> to John J. Kellogg and wife, containing 4.27 acres and re- <br /> corded in Book 92, Page 596, of the records of Hall County, <br /> Nebraska, thence North parallel with the West line of <br /> said Northwest Quarter of Northwest Quarter (►NW4NW4) of <br /> Section 34, 768.3 feet to a point 50 feet South of the <br /> North line of said Northwest Quarter of Northwest Quarter <br /> (NW4NW4) of said Section Thirty-Four (34); turning thence <br /> West parallel with the North line of said Northwest <br /> Quarter of Northwest Quarter (NW4NW4) of said Section <br /> Thirty-Four (34), 541.6 feet to the place of beginning, <br /> and containing approximately 11.59 acres, more or less, <br /> together with all right, privileges and uses connected therewith and the <br /> right to use the driveways adjacent thereto and connected, with Highway 30; <br /> and <br /> WHEREAS, the tract hereinabove described includes an area of <br /> 11.59 acres more or less and is the description of the entire tract of <br /> real estate owned by parties of the first part at this particular point; <br /> and <br /> WHEREAS, said tract erroneously incorporates far more ground <br /> than was intended to be leased to party of the second part; now <br /> To enable parties of the first part to consummate the sale <br /> and conveyance of the easterly portion of this tract of.real estate <br /> without any cloud resulting from the Contract and Lease Agreement herein- <br /> above referred to dated March 4, 1952, and for and in consideration of <br /> the sum of $1.00 in hand paid the party of the second part does herewith <br /> specifically release the following described portion of.said premises <br /> from said Contract and Lease Agreement of March 4, 1952• and does herewith <br /> acknowledge that he has no interest and claims no interest in the follow- <br /> ing described portion thereof under and by virtue of said Contract and <br /> Lease Agreement: <br /> -1- <br />
