an automobile greasing plant and to construct and maintain in con- <br /> nection with such station and plant, driveways and approaches upon, <br /> over and across the sidewalks, parkways and curbing fronting said <br /> premises, to furnish means of ingress to and egress from the same. <br /> It is mutually understood and agreed that if Lessee shall be unable <br /> to procure such permits and permits necessary for the continuance <br /> of such business, this lease shall at the option of Lessee cease and <br /> terminate from the date of written notice from Lessee to Lessor of <br /> Lessee 's inability to procure such permits and of its election to <br /> cancel and terminate this lease on such account. Upon the giving <br /> of such notice, this lease shall terminate and become void and <br /> neither party shall be liable to the other party on account of any <br /> obligations herein contained, except that Lessee shall be liable <br /> for rentals to the date of such notice. <br /> ARTICLE IX. <br /> IMPROVEMENTS <br /> Lessor represents and warrants it is the owner of all <br /> structures now on the demised premises and has full right to sell, <br /> remove or otherwise dispose of the same. Lessor hereby authorizes <br /> Lessee to remove or cause to be removed all structures now on said <br /> premises. All salvage from existing structures shall become the <br /> property of Lessee. <br /> Provided Lessee can procure the necessary permits for <br /> demolition and removal of the existing structures, can remove said <br /> structures without interference from any third party and can procure <br /> the necessary permits for the construction of an oil and gasoline <br /> service station on the demised premises, Lessee shall at its expense <br /> remove or cause to be removed said structures and construct on the <br /> demised premises and equip in such manner as Lessee shall see fit <br /> a modern gasoline and oil service station. Lessee shall have the <br /> right and privilege of erecting, equipping, placing, operating and <br /> maintaining on said premises all buildings, structures, improve- <br /> ments, driveways, tanks, containers, piping, signs, appliances and <br /> equipment of whatsoever character on, under and above the ground <br /> that it may require or desire to use in operating, transacting and <br /> conducting on said premises the business of storing, marketing and <br /> distributing petroleum products by means of a gasoline and oil <br /> service station, or by other marketing methods, and any other busi- <br /> ness incident to that of a service station, it being understood <br /> that Lessee is not hereby restricted from using said premises for <br /> any other lawful purpose. <br /> It is understood that title and sole ownership of all <br /> improvements placed on said premises by Lessee shall remain the <br /> property of Lessee during the original and any extended term or <br /> terms of this lease and Lessee shall have and retain the entire <br /> insurable interest in such improvements during the entire period <br /> of Lessee's occupancy of the premises. <br /> Lessee shall have the right to make proper connections with <br /> any and all water, gas, electric and sewer lines and pipes on or <br /> serving the demised premises, and may continue the use and service <br /> thereof during the term of this lease. <br /> Upon the termination of this lease in any manner or for any <br /> cause, other than by lapse of time, or by reason of the fault, <br /> omission or neglect of Lessee, Lessee may at its option and at its <br /> own expense, remove from said premises any and all buildings, im- <br /> provements, equipment and other property of whatsoever nature placed <br /> or owned by it thereon and after such removal shall restore the <br /> surface of the ground to its uniform and even condition, free from <br /> all excavations and debris. Upon the termination of this lease by <br /> lapse of time or by reason of the fault, omission or neglect of <br /> Lessee,all buildings and improvements placed or owned by Lessee on <br /> - 3 - <br /> iryc �•• <br /> —/C/— <br />
