<br /> August Lewis Fonner, being first duly sworn, on
<br /> his oath deposes and says that he is the owner of the
<br /> premises,"_togethbr with his wife, Emma Penner, as
<br /> Joint Tenants, leased to Phillips Petroleum Company,
<br /> a Corporation, which lease is recorded in Book 1 at
<br /> page 57 of Miscellaneous Records in the otEfice7of
<br /> Register of Deeds of Hall County, Nebraska.
<br /> That the Lizzie Turner who is one of the grantors
<br /> in the warranty deed shown at - entry No. - 35 of the
<br /> abstract to these premises, and which deed was re-
<br /> corded in Book 70 at page 440 of the Deed Records
<br /> in the office* of the Register of Deeds of Hall
<br /> County, Nebraska, was one and the same person as
<br /> the Lizzie Fonner named as grantee in warranty deed
<br /> shown at Entry No., 20 of said abstract and recorded
<br /> in Book 11 at Page 201 of the Deed Records in the
<br /> office ,of the Register of Deeds of Hall County, Nebr-
<br /> aska.
<br /> That the said deed referred to above as having
<br /> been recorded in Book 70 at Page 440 was delivered
<br /> to me upon the execution and acknowledgment thereof
<br /> by the grantors named therein; that said deed was
<br /> in my exclusive possession from that time until it
<br /> was recorded; .that there was no restriction placed
<br /> upon me by the grantors or any other person which
<br /> would have prevented my recording of said deed at
<br /> any time after it was delivered to me; that the
<br /> reason said deed was not sooner recorded by me was
<br /> so that no third persons would know that I had the
<br /> legal power to evict the grantors from said prem-
<br /> ises:
<br /> That my -said wife and I-, as Joint Tenants, are
<br /> in exclusive possession of said premises as against
<br /> all parties, including the Kansas-Nebraska Natural
<br /> Gas Company, Inc. , subject to the rights of Phillips
<br /> Petroleum Company, a Corporation, under their said
<br /> lease referred to in the first paragraph hereof, and
<br /> • subject to the easement for right-of-way purposes
<br /> held by the State of Nebraska and the County of Hall
<br /> for highway purposes along the west edge of said
<br /> Northwes t nuarter of the Southwest Quarter of Section
<br /> 22, Township 11, North, Range 9, West of the 6th P.M. ,
<br /> in •Hall County, Nebraska, being a strip of,-land 33 -
<br /> feet wide.
<br /> That no repairs or improvements have been made
<br /> on the premises described in said lease mentioned
<br /> in the first paragraph hereof for which mechanic's
<br /> or materialmenst liens could be filed.
