The second party agrees that there shall exist across the above <br /> described tract a perpetual easement for said track; that the track and the <br /> ties shall remain the property of the first party; that the second party will <br /> maintain said track and ties in accordance with the rules of the Chicago, <br /> Burlington and Quincy Railroad Company during the terms of this easement, <br /> and that such use as second party may make of said track shall be in accordance <br /> with the rules of said Company; that he further will control weeds on ground <br /> occupied by said spur so that the same shall not become a fire hazard; and <br /> he will not impede the traffic on said spur track. <br /> Parties hereto agree that such easement is for the benefit of lands that <br /> are now served by such track, as well as the benefit of such lands as may be <br /> in the future served by said track, or any extension thereof.
