CONTRACT <br /> WHEREAS, Kenneth C. Rains, a single person is conveying to Earl <br /> Grimminger `the following described Real Estate: <br /> A Part of the North Half of the South Half of the Northwest Quarter of <br /> the Southwest Quarter (N S- NW+SW4) of Section 4, in Township 11, North, <br /> Range 9. West of the 6th P.M., Hall County, Nebraska, more particularly <br /> described as follows: Beginning at a point 330 ft. North of the Northwest <br /> corner of Rains First Addition to the City of Grand Island, Nebraska, running <br /> thence North along the East line of the public Highway to the West of the above <br /> described premises for a distance of 247.5 ft., running thence East at right <br /> angles for a distance of 578 ft. , running thence South at right angles for a <br /> distance of 247.5 ft., running thence West at right angles for a distance of <br /> 578 ft., to the place of beginning; reserving in said tract an 8 ft. easement <br /> for utilities, the South line of such easement is an East and West line 130 ft. <br /> North of the South property line of the premises herein conveyed and parallel <br /> therewith; said easement being for any and all utilities for the benefit of adjoin- <br /> ing lands; said easement being perpetual and to be at all times available for the <br /> installation, maintenance and repair of utilities, for adjoining lands. Also <br /> subject to an easement and agreement for the use of a spur track now on the <br /> premises, as contained in a separate recorded agreement. <br /> Included in such conveyance is a strip of land 50 ft. wide for which the <br /> grantee, Earl Grimminger, is paying no consideration except the obligations <br /> and duties herein set-out, and upon which 50 ft. is located a spur track running <br /> from the Chicago, Burlington and Quincy Railroad,w& iich_tirack and ties is the <br /> property of the grantor, Kenneth C..Rains, and which track was installed for <br /> the purpose of serving the above described tract as well as other tracts; and <br /> the parties hereto desiring to enter into an agreement relative to the maintenance <br /> and use of said track, it is hereby agreed by and between Kenneth C. Rains, <br /> hereinafter referred to as the first party, and Earl Grimminger, hereinafter <br /> referred to as the second party, as follows: <br />
