JOSEPH:AND GRAND ISLAND RAILWAY COM- <br /> PANY, a corporation of the States of Kansas and Nebraska, and <br /> its Lessee, UNION PACIFIC RAILROAD COMPANY, a corporation of <br /> t State of Utah (hereinafter collectively called "Railroad <br /> Co pang") , mod`KANSAS-NEBRASKA NATURAL GAS COMPANY, INC. , a <br /> ( corporation of the State of Kansas, with principal place of <br /> business gt ,Phillipsburg, Kansas. (hereinafter called "Licen- <br /> see") WITNESSETH: <br /> RECITALS: <br /> The Licensee desires to construct, maintain <br /> and operate a„1-1/4-inch steel gas pipe line <br /> (hereinafter referred to as "Pipe Line") across <br /> the right of way and under- the track of the Rail- <br /> road Company' s main line at a point 700 feet <br /> distant (when measured along the center line of <br /> said track) northerly of the center line of <br /> Walnut Street at Doniphan, Hall County, Nebraska, <br /> in the location shown by dashed orange lines on <br /> the print hereto attached dated October. 12, 1953, and <br /> marked "Exhibit A." <br /> ) AGREEMENT: <br /> NOW THEREFORE, it is mutually agreed by and between <br /> the parties hereto as follows: <br /> Section 1. RAILROAD COMPANY GRANTS RIGHT. <br /> In consideration of the sum of Ten Dollars ($10.00) <br /> to be paid by the Licensee to the Railroad Company upon the <br /> execution and delivery of this agreement and in further con- <br /> sideration Of the covenants and agreements herein set out to <br /> Jbeby the, Licensee kept, observed and performed, the Railroad <br /> ( Company hereby grants to the Licensee, subject to the terms <br /> conditions herein stated, the right to construct and thereafte , <br /> during the term hereof, to maintain and operate the Pipe Line <br /> 1across said right of way and under said track in the location <br /> shown by dashed orange lines on Exhibit A. <br /> 1 <br /> - o ® 7- <br />
