Page 15, <br /> ARTICLE :SCI. <br /> SURVEY: <br /> Lessor, at its expense, shall immediately furnish to <br /> Lessee a plat of survey on tracing linen or vellum prepared by a <br /> registered land surveyor, showing thereon: Property line dimen- <br /> sions and angles; corner markers; locations of existing structures , <br /> utilities and obstructions ; encroachments and easements; abutting <br /> streets, highways and alleys showing rights-of-way widths, widths <br /> of street, highway and sidewalk paving and street and highway <br /> names; locations of any restriction, setback or building lines ; <br /> elevations within leased area and at tops of curbs, street and <br /> highway center lines and along gutter lines; north arrow; legal <br /> description and plat book reference of leased area and easements; <br /> name of city, county and state in which leased area is located; <br /> surveyor's certification, address and signature. <br /> ARTICLE XXII. <br /> TITLE EXAMINATION: <br /> Notwithstanding any and all of the above, it is under- <br /> stood and agreed by and between the parties hereto that this <br /> lease is to become effective and binding upon Lessee only upon <br /> Lessor's furnishing to Lessee for examination an Abstract of Title <br /> prepared by a competent abstracter and certified from title in the <br /> Government down to and including the date of recording of the <br /> lease, which Abstract shall, in the opinion of Lessee, show good <br /> merchantable title vested in Lessor, free and clear of any and all <br /> liens and encumbrances whatsoever, or at Lessee's option, such <br /> title vested in Lessor as, in Lessee 's opinion, will authorize <br /> Lessor to make and enter into this lease and to collect and retain <br /> all rents and payments hereunder, free and clear of any and all <br /> claims and demands made by any and all persons or parties whomso- <br /> ever. In the event the premises shall be burdened with any mort- <br /> gage, trust deed or other encumbrance, the same shall be rendered <br /> subordinate and inferior to the leasehold estate and other rights <br /> herein granted Lessee by an instrument in writing satisfactory to <br /> Lessee in form and substance . In the event Lessor shall neglect, <br /> refuse or be unable to furnish such proof of title within sixty <br /> (60) days after the recording of this lease, and Lessee shall not <br /> elect to waive the same, this lease shall, at the option of Lessee <br /> and upon notice to Lessor, become absolutely null and void from <br /> the date hereof. Lessee shall have a reasonable time within which <br /> to examine said Abstract. <br /> Lessor agrees to record this lease at its expense <br /> immediately upon receipt of an executed counterpart and have such <br /> recording shown in the Abstract of Title to be supplied by Lessor <br /> as above provided. <br /> n <br />
