Page 5. <br /> installation work and to deliver said premises to Lessee in the �j. <br /> completed condition hereinabove specified on or before the % �T <br /> day of a/,c9N0q,e , 195- , Lessee shall have the option <br /> of cancelling and terminating this lease by notice to such effect to <br /> Lessor; and, in the event this lease is so terminated, Lessee shall <br /> not be liable to Lessor on account of any covenants or obligations <br /> herein contained. <br /> It is covenanted and agreed that in the approving or fur- <br /> nishing of plans and specifications or in the making of inspections <br /> by Lessee mentioned in the foregoing paragraph, Lessee is acting on <br /> its own behalf and not as an agent of Lessor . It is further cov- <br /> enanted and agreed that in the performance of any work by Lessor in <br /> connection with the erection and construction of the improvements <br /> and facilities required of Lessor under the terms of this lease, or <br /> in repairing, rebuilding or replacing, Lessor shall perform no act <br /> or make no representation to any person or persons whomsoever that <br /> Lessor, its agents or representatives, is the agent or agents of <br /> Lessee in any particular. <br /> Lessor agrees to provide, furnish and maintain, at its <br /> own expense , a suitable and adequate water supply, and sanitary <br /> sewerage system. Lessor, at its sole expense, shall connect the <br /> sewerage system to a public sewer line whenever same is or shall <br /> hereafter become available to the premises . Lessor shall also bear <br /> all charges by any public authority arising out of the establish- <br /> ment or maintenance of any sewer line serving said premises . If <br /> either said water or sewerage systems fail to work properly during <br /> any day or days, the rent reserved in this lease shall cease to <br /> accrue, and Lessor shall not be entitled to collect, nor shall <br /> Lessee be obligated to pay, any rent for such day or days as Lessee <br /> is without water or a working sewerage system in a sanitary condi- <br /> tion <br /> When said premises are delivered to and accepted by Lessee <br /> ready for occupancy, the parties hereto shall sign a written memo- <br /> randum, supplemental to this lease, fixing and specifying such date <br /> as the date of the commencement of the term for all matters in con- <br /> nection with this lease. <br /> In the event any equipment which may belong to Lessor <br /> shall be embraced within this lease and shall wear out, become <br /> obsolete or otherwise unsuitable for Lessee 's business , Lessee shall. <br /> have the right to replace the same with its own equipment, which <br /> shall remain Lessee 's property, and may be removed by Lessee at any <br /> time . If Lessor's equipment is discarded for any cause, Lessee <br /> shall undertake to give Lessor notice in order that Lessor may take <br /> the same from said premises , after being detached and laid aside by <br /> Lessee, but Lessee does not obligate itself to give Lessor such <br /> notice and assumes no liability for failure to do so . <br /> Lessee shall <br /> furnish and Lessor at Its expense sh 1.1 ins';: 11 one ( 1) air compresso r, <br /> Lessee stall have full right to remove its property as herein else- <br /> where provided. 111)3' , <br /> • <br /> 33- <br />
