<br /> THIS DEED, made ti}is 8th day of July, 1974, by and between JOHN R.
<br /> HIGGINS, of Grand Island, in the County of Hall, State of Nebraska, Executor of the
<br /> Last Will and Testament of WALTER A. DAVIS, Deceased, late of Grand Isiand, in
<br /> the County of Hall, State of Nebraska, Pat^ty of the First Part, and ANTONIO S. ROMAN
<br /> and ANGELITA M. ROMAN, husband and wife, as joint tenants, and not as tenants in
<br /> common, of Grand Island, in, the County of Hall, State of Nebraska, Parties of the Sec-
<br /> ond Part:
<br /> WITNESSETH, That the said Party of the First Part, the duly appointed,
<br /> quaiified and acting Executor of the Estate of Waiter A. Davis, Deceased, under his
<br /> Last Will and Testament which is record in the office of the probate court of Hall
<br /> County, Nebraska, by virtue of'the power and authority granted and conferred upon
<br /> him, under the said Will, and in consideration of the sum of EIGHT THOUSAND AND
<br /> NO/100 ($8,000.00) DOLLARS to him paid by the Parties of the Second Part, the re-
<br /> ceipt whereof is here,by confessed and acknowledged, does by these presents grant,
<br /> bargain, seli, remise, release, alien, convey and confirm unto the said Parties of the
<br /> Second Part, and to their heirs and assigns forever, all the foliotiving described real
<br /> estate situate, lying and being in the County of Hail, and State of Nebraska, to-�wit:
<br /> Lot Four (4) , in Block Eleven (11) , of Lambert's Addition
<br /> to the City of Grand Island, Hall County, Nebraska,
<br /> together tivith all and singular the tenements, hereditaments and appurtenances there-
<br /> unto belonging or in anywise appertaining; and also all the estate, right, title, inter-
<br /> est, property, possession, clairn and demand whatsoever, tivhich the said testator had
<br /> in his Iifetime, and at the time of his decease, and �which the said Party of the First
<br /> . Part has by virtue of the said Last Will and Testament, or otherwise, of, in, or to the
<br /> above granted premises, and every part and parcel thereof, with the appurtenances.
<br /> To have and to hold the said premises, the tract of land aforesaid, with the heredita-
<br /> ments and appurtenances thereof, unto the said Parti.es of the Second Part, their heirs
<br /> and assigns, forever.
<br /> And the said Party of the First Part, for himself, his heirs, executors
<br /> and administrators, does covenant, promise and undertake to and with the said
<br /> Parties of the Second Part, their heirs and assigns, that he is lawfully the Executor
<br /> of the Last Will and Testament of the Estate of Walter A. Davis, Deceased, and has
<br /> potiver to convey as af'oresaid, and has in all respects acted, in making this convey-
<br /> ance, in pursuance of the authority granted in and by the said Last Wili and Testament;
<br /> and that he has not made, done or suffered any act, matter or thing whatsoever, since
<br /> he was Executor as aforesaid, whereby the above granted premises, or any part there-
<br /> of, are, shali or may be impeached, charged or incumbered, in any manner whatsoever.
<br /> IN WITNESS WHEREOF, the said Party of the First Part has hereunto set
<br /> his hand the day and year first above written.
