<br /> �4' � KNOW ALL MEN BY THESE PRESENTS, That COMMONWEALTH NEBRASKA DRIVE-
<br /> = IN THEATRES CO., a Nebraska corporation, Grantor, in consideration of TEN
<br /> � DOLLARS and other good and valuable considerations in hand paid, does here-
<br /> =-+ by Grant, Bargain, Sell, Convey and Confirm unto DONALD C. DIERS and
<br /> VIRGINIA L. DIERS, husband and wife, as joint tenants, with right of survi-
<br /> = vorship, and not as• tenants in common, Grantees, the following described
<br /> -= real estate situate in the County of Hall and State of Nebraska, to-wit:

<br /> �: Lot 2, COMMONWEALTH BUSINESS PARK SUBDIVISION,
<br /> a subdivision in Hall County, Nebraska, accord-
<br /> �' ing to the recorded plat thereof; subject to re-

<br /> This Deed is made, delivered and accepted, however, upon the following can- ,
<br /> ditions, which shall be deemed covenants running with the land, to-wif�
<br /> ' (a) For a period of five (5) years from the date hereof,
<br /> the use of the above described property shall be
<br /> restricted to an automotive vehicles sales agency
<br /> � devoted primarily to the sale of new automotive
<br /> ' vehicles, secondarily to the sale of used auto-
<br /> motive vehicles, and in conjunction therewith the
<br /> mechanical servicing and repair of automotive
<br /> vehicles; ,
<br /> (b) For a period of fifteen (15) years from the date
<br /> hereof, the use of the above described property
<br /> shall be further restricted against promotional
<br /> activities which involve amplified sounds which �
<br /> carry beyond the boundaries of the above described �
<br /> property, unusual displays of flashing lights, and
<br /> • displays which are not normal procedures in the
<br /> •operation of automotive sales and service agencies;
<br /> (c) The above described property shall be further
<br /> permanently restricted against any lighting thereon
<br /> which, during the hours that Grantor's drive-in
<br /> motion picture theatre lying easterly therefrom
<br /> shall be in operation to the extent that light from
<br /> the above described property, either direct or
<br /> • ambient, shall fall: upon any portion of said drive-
<br /> in theatre premises in such manner as. to interfere
<br /> with the enjoyment by the patrons of said Drive-In
<br /> Theatre of the entertainment then being provided
<br /> , in the Drive-In Theatre premises;
<br /> (d) The use of the above described property shall further
<br /> be permanently restricted to prevent the placing of
<br /> any public utilities above ground on any part of the
<br /> above described propert}�, other than on a temporary �
<br /> basis; and
