<br /> County, Nebraska, Case No. 18190, wherein Nellie H. Parker is designated Plaintiff
<br /> • by order of the Court and Jennie Parker Dibbern is Party Defendant, for partition
<br /> of the premises �iereinafter described, the undersigned Referee, appointed by said
<br /> Court td make paxtition of said real estate, made report in writing, duly signed,
<br /> setting.forth that partition of said real estate could not be made without prejudice
<br /> to the owners thereof, which report was duly examined by said Court, and said Court
<br /> -- being satisfied ther,ewith confirmed the same, and thereupon entered an Order directing
<br /> me as said Referee to sell said premises on the following terms, to-wit: Fifteen (15)
<br /> percent cash at the time of the sale, and the balance of Eighty-five (85) percent upon
<br /> confirmation of the sale, and iri pursuance of said Order, I caused a notice to be pub-
<br /> lished in The Grand Island Daily Independent, a newspaper printed and in general 'y

<br /> in said natice, and after said notice had been published for more than thirty days as
<br /> provided by law, I offered said real estate, to-wit:

<br /> west Quarter (NW�aNW�) , Section Twenty-three (23) , Township Nine
<br /> (9) North, Ra.nge Twelve (12) West of the 6th P.M., Hall County,
<br /> Nebrasl�a, excepting therefrom 20.33 acres, sa'id tract containing
<br /> 94 acres, more or less, and also described as all of that part of
<br /> Lots Three (3) and Four (4) and the Northwest.Quarter of the North-`
<br /> west Quarter (NWaNW�a) , Section Twenty-three (23) , above described,
<br /> lying North of Interstate #80,
<br /> for sale at public auction and sold the same to Rudolph Schmidt, for the sum of
<br /> $39,072.00, he being the highest bidder therefor. And afterwards on the 3rd day of
<br /> ,7anuary, 1974, said Court approved and confirmed said sale and by an Order, directed
<br /> me as Referee to execute to said Rudolph Schmidt a "Deed conveying said land to.him
<br /> in fee simple.
<br /> NOW, THEREFORE, I, JosephD Martin, Referee, in consideration of the premises
<br /> and the sum of $39,072.00, so bid and paid by said Rudolph Schmidt, and by virtue of .
<br /> the powers vested in me by law, do by these presents grant, sell, and convey unto the
<br /> said Rudolph Schmidt and to his �heirs and assigns, the real estate described as follows:
<br /> Lots Three (3) and Four (4) and the Northwest Quarter of the North-
<br /> west Quarter (NW�NWa) , Section Twenty-three (23) , Township Nine (9)
<br /> North, Range Twelve (12) , West of 'the 6th P.M., Hall County,. Nebraska,
