<br /> - KNOW ALL M�N BY THESE PRESENTS: „
<br /> WHEREAS, at the time of his death, Oren A. Beltzer, was the owner. of the
<br /> real estate hereinafter described, and said deceased left a Last Will and
<br /> / Testament which,was admitted .to probate in the manner and form provided by. law
<br /> in the County Court of Hall County, Nebraska, and which Last Will and Testament
<br /> has. never been set aside or appealed from. Under paragraph FIFTA of the Last .
<br /> - Will and Testament of said .deceased, the rest, residue and remainder of his
<br /> � estate was given, devised and bequeathed to Grand 2sland Trust Company, in trust;
<br /> that the real estate hereinafter described was a part of the residue and remain-
<br /> . der of the estate of said deceased, and is held by Grand Island Trust Company, in
<br /> , trust, in accordance with the provisions of said Last Will and Testament; and
<br /> WHEREAS, the provisions of said paragraph FIFTH of said Last Will and
<br /> Testament directed Grand 7sland Trust Company, to pay the net income therefrom
<br /> semi-annually to Nell M. Beltzer, wife of said deceased, for the term of her
<br /> natural life, which direction has been carried out by the trustee; that the said
<br /> Nell M. Beltzer, died on April 16, 1973, and her interest in said trust property ,
<br /> terminated with her death. Upon her death, the Trustee was directed to deliver
<br /> the assets of the trust estate to the children of the deceased Oren A. Beltzer,
<br /> � they being James Beltzer, Joanne Beltzer Flory and Glilliam Beltzer, or to their '
<br /> , issue by right of representation; that all three named children are alive; and,
<br /> WHEREAS, said named children have requested and directed Grand Island Trust
<br /> Company, �rustee, to convey the real estate comprising the t•rust estate held by
<br /> the Trustee in accordance with the agreement reached between tnem for the physical
<br /> partitioning of said real estate;
<br /> NOW, THEREFORE, the undersigned Grand Island Trust Company, a .corporation,
<br /> ' as such Trustee under the Last Will and Testament of Oren A. Beltzer, Deceased,
<br /> in consideration of the premises, and by virtue of.and in execution of the powers
<br /> given in and by said Last Will, and Testament, and zn accordance �aith the request
<br /> and direction of the children of said deceased to carry out the partition of real
<br /> property, in said trust estate, do hereby grant, ba�gain and convey unto ,�,�g g�
<br /> BELTZER all of the following tract and parcel of land in the County of
<br /> Hall , State of Nebraska, more particularly described as follows:
<br /> North Half o£ the Southeast Quarter (N'� SE�) and South Half of the
<br /> Northeast Quartar (S� NE�) of Section Seven (7), in Township Nine
<br /> (9) North� Range Twelve (12)e West of the 6th P. M.
<br /> TO HAVE AND TO HOLD the above described premises, together with all
<br /> tenements, hereditaments and appurtenances thereto belonging unto the grantee(s) ,
<br /> and to the heirs and assigns of the grantee(s) forever.
