'I'he ,Ci�y of Grand Island, Nebraska,:,by action of its city council on <br /> March 19, 1973, enacted Ordinance No. 5365 which d3rectecl` the conveyance of <br /> the real es�ate 'described below and the manner and terms thereof. <br /> 2. Ordinance No. 5365 was published in the Grand Island Dai1y Independent, <br /> a legal newspaper published in and of general circulation in such City on <br /> March 23, 1973, and, immediately thereafter, notice of such sale and the terms <br /> thereof were published in the Grand Island Daily Independent for three consecutive <br /> weeks, on March 26, 1973, Apri1 2, 1973, and April 9, 1973, a11 as required by <br /> Section 16-202, R.R.S. 19�+3. <br /> 3, No remonstrance against such sale was filed with the city council of <br /> the City of Grand Island, Nebraska, within thirty days of the passage and pub- <br /> lication of such Ordinance No. 5365• <br /> 4, Section 5 of Ordinance No. 5365 provides that if no remonstrance be <br /> filed against such conveyance, the mayor and city clerk-finance director sha11 <br /> make, execute, and deliver to Wheeler Farm Supply Co. of Grand Island, a quitclaim <br /> deed for said real estate, and the execution of such quitclaim deed is hereby <br /> authorized without flzrther action on behalf of the city counil. <br /> NOW, THEREFORE, the City of Grand Island, Nebraska, a municipal corporation <br /> in Iial1 County, Nebraska, as Grantor, in consideration of the conveyance by <br /> Wheeler Farm Supply Co. of Grand Island, and Diversified Builders, Inc., a <br /> Nebraska corporation, of a sixty-foot wide tract of 1anc1 to the City for a new <br /> access road right-of-way, such tract being located in Lot 7, B1ock 1, Nelsen <br /> Second Subdivision, and lying between the north line of the existing access <br /> road right-of-way and the south line of Old Potash Highway, as shown on Exhibit <br /> "A" attached hereto, to�ther with additional right-of-way for 01d Potash Highway <br /> and Webb Road, as shown on Exhibit "A"; and the further consideration that the <br /> Grantees agree to pay the City for the actual cost of constructing a thirty-three <br /> foot wide Portland cement concrete street with curb and gutter and storm sewer <br /> in the new sixty foot wide access road from the north line of U.S. Highway No. <br /> 30 to the south line of Olcl Potash Highway, such payxnent to be made to the City <br /> in one lump sum within thirty days after the statement of costs is delivered to <br /> the Grantees-, does hereby quitclaim, grant, bargain, se11, convey, and confirm <br /> unto <br /> WHEELER FARM SUPPLY C0.
