<br /> THIS DEED entered into this 17th day of April, 1973, between Rose_ �
<br /> McHargue and Asthur C. Mayer, Co-executors under the Last Will and Testa-
<br /> m,�t of Josephine H. Hays, deceased, Grantors, and Walter C. Hoppe and
<br /> E�eanor M. Hoppe, as joint tenants, Grantees;
<br /> WITNESSETH, that the Grantors, being the duly appointed, qualified,
<br /> arid acting Co-executors of Josephine H. Hays, deceased under her Last
<br /> Will and Testament admitted to probate in the County Court of Hall County,
<br /> Nebraska in Estate No. 8612, by virtue of the power and authorit� grant-
<br /> ed them under said Will, and in consideration of the sum of Eleven Thou-
<br /> sand Five Hundred & no/100 ------ ($11,500.00)----Dollars, to them paid
<br /> by the Grantees, receipt whereof is hereby acknowledged, do by these
<br /> presents grant, bargain, sell, remise, release, convey, and confirm '
<br /> unto the grantees, as joint tenants, and to their assigns, and to the
<br /> heirs and assigns of the survivor as between them, the following des-
<br /> cribed real estate, to-wit:
<br /> Easterly Forty-Eight Feet (E48' ) of Lot Ten (10) , in Block
<br /> Eighty-Seven (87) , in Wheeler and Bennett's Fourth Addition
<br /> to the City of Grand Island, Nebraska,
<br /> Together with all and singular the tenements, hereditaments and appur-
<br /> tenances thereunto belonging or in anywise appertaining and also all of
<br /> the estate, right, title, interest, property, possession, claim and
<br /> demand whatsoever, which the said Testatrix had in her lifetime, and at
<br /> the time of her decease, and which the said Grantors have by virtue of
<br /> the said Last Will and Testament, or otherwise, of in or to the above
<br /> granted premises, and every part and parcel thereof with the appurtenances;
<br /> TO HAVE AND TO HOLD the said premises with the hereditaments and
<br /> appurtenances thereof unto the said Gr antees and to their assigns, and
<br /> to the heirs and assigns of the survivor as between them, forever.
<br /> Grantors for themselves, their successors, heirs, executors, and
<br /> administrators covenant with the Grantees that they are lawfully the
<br /> Co-executors under the Last Will and Testament of Josephine H. Hays,
<br /> deceased; that they are lawfully seized of said premises; that said
<br /> premises are free from encumbrance and that they have the power to con-
<br /> vey the same; that they have in all r�spects acted, in making this con-
<br /> veyance, pursuant to the authority granted them under the Last Will and
<br /> Testament of Josephine H. Hays, deceased; that they have not done, made,
<br /> or suffered any act, matter or thing whatsoever, since they were co-
<br /> executors of said estate, whereby said premises or any part thereof are,
<br /> shall, or may be impressed,charged, or encumbered in any manner whatso-
<br /> ever; that they will promptly complete the estate of Josephine H. Hays,
<br /> deceased, andwill effect a release of any existing or potential liens
<br /> against these premises arising from such estate proceedings.
